I’m wondering how liable the seller is when filling this form in?

Eg. When we bought the house there was a damp wall, sellers said they solved it, they hadn’t they’d hid it. We’ve subsequently spent thousands fixing the root cause and in time it’ll now dry out.

When we come to move, what time frame is the form over? Do we specify we did have damp then we fixed it? Or does that make me permanently liable if it comes back? If we have solved it and no longer experience it do we just not say it ever was?

I’m a little confused, any experience with this would be fab.

On the property information form you list all the work that you have done on the house during the period you owned it.
So you would say damp wall fixed and date and name of company that fixed it. If the company gave you a guarantee then the date that ends.
If the problem reoccurs within the guarantee period the company will be liable.
We sold our house earlier this year and had a 30 year guarantee but my understanding is that 20 years is more usual now.
If there is no guarantee for the work then you may be asked to sign an indemnity policy which is a type of insurance against this type of scenario.

I think it is over the houses lifetime but it mainly focuses on your period. I don't think you have to mention damp unless specifically asked though not a legal expert. The historic things we mentioned were major things like an extension as the house is over 100 years old so can't mention everything ever or know it. It seemed to focus on work requiring planning / building control. Ask you solicitor to be certain.

Thanks for the response! That makes sense.
There is no guarantee for the work, it’s a case of releasing an old building from its cement casings.. removing the cement render and rerendering with lime and adjusting airflow through brickwork.

Could take a year to dry up totally but we’ve noticed immediate improvements.

I suppose that’s what I’m concerned about. We know there was damp because we had to deal with previous attempts to hide it.

But whilst we have taken action to resolve that doesn’t mean there is a ‘guarantee’. I just don’t know what to say moving forward without making ourselves liable indefinitely.
