Completion day - today. Help!!

Is there a usual time for completion to go through?

We were told last week by our solicitor to hand keys over at noon. I held off and rang for and update but nobody called back. I rang the agent and they said the buyer hadn't yet been asked for the funds.

This was at 1. The agent asked the solicitor for an update also but they have also heard nothing.

Is there a usual completion time and should I be worried?

We sold via auction if that makes a difference

They're serving a completion notice.

They "expect" completion to happen tomorrow now. I'm shitting myself...

How frustrating for you. What happens now? Is it just the marriage cert that's needed? What happens if it doesn't happen tomorrow?

The latest was that the buyers solicitor was waiting for the funds to be transferred so I'm hoping it was just a case of it being too late in the day.

As far as I'm aware they get an instant fine as the notice is served and they accrue interest for each day it drags out.

Our solicitor said they expect it to complete tomorrow - I just hope to god it does as we're already quite a bit expense down.

With it being an investor I doubt he'll want to forfeit the deposit so fingers crossed!

Well I'm not sure he will have a choice.

Sounds like exchange and complete on the same day tho which I believe is happening a lot at the minute so assume forfeit of deposit doesn't stand.

I'd tell them to go sod themselves asking for a marriage certificate - it has no possible relevance surely?

They've asked for our marriage certificate when we've sold, I presume to check there's no problems and all legal & proper. I remember the solicitor made a comment about the vendors of our current house that she was now Mrs Z formally Mrs Y nee Miss X - I think she'd been married and divorced then remarried so checking it was all legally hers etc.

Yeah - I think it's as on the deeds I would be under my maiden name?

Either way, our solicitor has the original copy of my marriage certificate so it shouldn't be an issue. Just confused as to why it's taken this long for them to request it given we exchanged 28 days ago!

At this point I'll give them whatever they ask for!

Just annoying as I took the day off work yesterday for no reason at all. Today I'm back at work so going to be running around like an idiot trying to drop keys off etc

So apparently they are in receipt of the "first lot" of funds and due to the limit on transfers the rest is expected today (I don't know if this is correct / sounds about right?)

It's a low value house so I'm not sure and you would think there would have been a plan in place. We'll see....

Oh OP, best of luck with today, hope it goes smoothly. Going back to your original question, I would never hand the keys over at a pre agreed time, but would wait for a call from the solicitor to say the funds had been received. When we last sold, our buyers were outside our house with a van full of their stuff, waiting to unpack. Our solicitor wouldn't allow the keys to be handed over, or for them to have access to the house until the funds had hit her account.

So far they've thought of three excuses

  • want the marriage certificate


  • weren't asked for the money


  • amount if money was greater than they'd planned


None of them are remotely convincing.

Agree with Piglet. None of these reasons are convincing. I'm unsure why there would be a limit on funds for a house? Surely you agree the transaction prior to needing the money so the bank has the money ready, whether it's yours or a loan.

What is your solicitor saying?

Well I feel like I'm doing the job of the solicitor to be honest.

My solicitor is saying they can't get in contact with the buyers solicitor and that they're ignoring them.

The estate agent is sending me updates about what the buyer solicitor has told her (which is just that they're waiting for the rest of the funds clearing).

I'm bloody communicating this to my solicitor!!

When we completed last week, our solicitor requested funds to be released to their account the day before completion. On completion day we were told to collect keys at about 9.45am. I assumed many Solicitors now request funds for the day before? No?

One move we didn’t get the keys until 4.45pm with all our stuff in a lorry and pissed off removal men. The reason? Their solicitor had gone for a long lunch meeting and hadn’t confirmed receipt of the funds before she went. I hate solicitors!

I bought at auction a few years ago. Paid 10% on the day of the auction and exchanged on the day as is usual, I then had 28 days to complete. I needed a mortgage to fund the purchase and as the deadline drew near it became apparent that it wasn’t going to be agreed before the 28 days. I told my solicitor as I wanted to let the seller know it’d be a couple of days late (and accept the penalties associated with that) my solicitor advised not to say anything as if I said I wasn’t able to complete on time I forfeited my deposit but if I said nothing and let the deadline pass we would then be into serving notices to complete etc. We did complete 3 days late I think and I paid about £150 extra because of it. This is probably why their solicitors are ignoring you and just proceeding with the notice to complete. It’s a bit shit. Hope it gets sorted quickly

So sorry you're going through this OP. I suggest you ask your own solicitor what financial recompense you'll be receiving from the buyer! I've never done an auction purchase/sale so I don't know if there are different rules to normal?

Yes! I'm no longer the owner of the property and I've received my chunk of the proceeds!

Thank you everyone for letting me vent and generally stress out over the last couple of days Grin
