Leaked Pipe - Insurance

Hi all,

We recently had a new kitchen fitted and there happened to be a leak under the sink from the plumber. At the same time, there was torrential ran so we believed the rain caused the issue and began a home insurance claim.

We then realised it was a leaking pipe and contacted the plumber who installed it. The plumber is in talks with his insurer and is debating sorting the work out himself. Our insurers have valued the work at £1600. But if the plumber also claims on his liability insurance, are we able to get both claims? Is it legal?

I will be battling the insurance company as it's more than £1600 damage but I just wondered if the home insurance company pays out and the plumbers insurance company too, does that mean we have to choose one or the other?
I cannot see anything in the policy that suggests we can't. We're with Policy Expert if that helps.

Any help with this would be much appreciated.

You will be asked if you are getting any insurance money from any other source
Will be fraud if you lie

You can't claim on both unless after his insurance company pays out you have additional losses. However as the third party you should be compensated for any losses you have incurred

Insurance is to put you back in the same position and not making a profit.

Update
The policy states we will not pay any claim that would be covered under any other insurance policy. However, if the other insurance has all been used up we will pay the amount that is over the cover available under that insurance policy.

Not sure if the plumbers insurance counts in this?

Also, what if the plumber decides to fix the work himself at no charge. Am I able to go ahead with the claim?

You can claim if you still have remaining losses but your insurer will seek to recover it from the plumber or his insurer. For this reason I suggest you don't claim on your own cover but seek to recover from him or his insurer as otherwise your own premium will go through the roof in renewal

@Marieg10 Thanks for your input. As we have already started a claim, my renewal will go up regardless of whether I proceed with the claim or not. That's why I'm hesitant to cancel the claim.

Try putting through a price comparison website a quote and insert the claim...see what price you get. I had a claim years ago and it cost me a fortune for 5 years and basically I ended up paying more in insurance premiums that I got paid out!!

Have a look and consider withdrawing the claim
