Hi does anyone know if housing will help me. I am going to be evicted with 2 kids on the 5th September. I just got the notice. The landlord gave me a section 21. It says there's no reason why he is going to evict me he wants his property back....it is private rent I had to get a loan to get the rent and deposit which now I am struggling to pay back 😑.so now I know I can't afford rent and deposit to get another property .

When does your contract run out? A LL has to give a tenant two months written notice. Your LL has given you notice. He is saying you have done nothing wrong he just wants the property back. Maybe he wants to live there himself. You need to look for another property to let. If you leave this property clean you should get back your deposit to put on to another house. Which general area are you living in?

The notice is notice he can start court proceedings. Not that you must leave on that date.

Also, how long is tenancy? What type of tenancy is it? Has the notice been served correctly?

It sounds like you are struggling to afford the current private rent, would that be correct? If so fighting to stay in a property you can't afford is pointless.

Look at this in a different way, if you intentionally make yourself homeless i.e give up the private tenancy because you realise it's not affordable you don't have much of a leg to stand on with the housing department. However if you are made homeless through no fault of your own which what you describe seems to be the case, you are in a much stronger position to be rehomed.

Are you claiming or entitled to any benefits you aren't already claiming in order to make private housing more affordable. This could be a blessing in disguise if you aren't coping financially with private rental costs.

If you can afford to stay in this property until forced out then you can make things difficult for the landlord if you choose to by not leaving in Sept. They will then have to apply to the courts to have you removed. The courts will then set a date you have to be out by and even then you can still ignore it. I can't remember exactly what happens at that point as have only ever had to evict one tenant. It is a stressful option and rent & bills are still payable up until you actually leave regardless of if you are then outside your lease.

Hi yes he has give me three months notice. It's assured hold tenancy the contract ran out in December...i have been paying the rent early or on time. But since recently I have been 1 week or 2 weeks late which I explained to him the reason why and he seemed fine about. The eviction notice doesn't say rent arrears for the reason for his eviction I live in Croydon moved in 11th June its a AST tenancy @caringcarer

It's a shit situation, sorry. Get on to Shelter and the council and explain the situation to them, but as mentioned there's no point struggling to pay the unaffordable rent, you'll just get in a worse and worse situation.

Contact Shelter or your council. The general advice is to sit tight until you are formally evicted. Then you will likely be rehoused in temporary accommodation.

As for people saying he can only start proceedings, this is factually correct, but what they aren’t telling you is that if it ends up with a court order and bailiffs you’ll never get a private rental Ever again.

So contact the council and explain you’re being evicted and going to be made homeless and ask for their help.

I'm so sorry to hear this, this is any renters worst nightmare.

Don't panic, look at shelter, contact your housing associations, look on your local council website.

Will you get your deposit back from this home? Presumably that could be put towards your next rental which sounds like it needs to be cheaper to make paying the bills easier.

Could you get a guarantor for your next property?

Are you claiming all the financial support you're entitled to?

I worked for a housing association for a long time, be wary of the “sit tight until you have bailiffs” advice, you will struggle to rent, even on a HA property. Which leaves you with temporary accommodation, which varies council to council but in urban areas it is often really very grim.
Go and speak to your councils housing department, take the s21 with you and discuss your options with them.

he hasn't used section 8 as that is very difficult to prove.

read this if England:

you will not be evicted on 5th Sept. That is the earliest date that he can start the legal process to get a notice of possession. Even when that arrives, you still do not have to leave. You do not actually have to leave until the bailiffs arrive - you'd get warning. If you are asking for council help they will make you stay until then.

there was already a massive court backlog, it could be months before the process completes assuming he has got all the paperwork right. Doesn't help you, I know.

..of course that doesn't stop the council playing you up due to the shortage of accommodation. They will try everything to make you leave earlier.

The best action is to take control and find somewhere that you can afford, even if it means going a long distance.

Hi all spoke to the landlord his reason is because is when I pay the rent it's late even though I always tell him it's going to be late and the readon..i was told that housing won't help me if they call him and talk to him they will convince him to make me stay. And also if I wait for bailiffs I will have to pay for the court etc. I am worried..ive had no luck getting through to housing and shelter no answer. But I emailed housing options my situation 😭😭😭. On the section 21 it just says he wants the property back doesn't say anything about late rent payments. Not sure what to say to housing when I
get through to them

the section 21 is a 'no fault' eviction so it won't mention your late payments. There is a 'fault' eviction which is section 8, unless you are consistently two months behind that won't be valid.

yes you would be liable for bailiff and eviction costs, although that is rarely enforced as needs a separate action. This is one reason why councils shouldn't make you wait for the bailiff, but of course they do because there is so little council accommodation.

you clearly cannot afford this place. Everything Shelter will say to you is online, quite often linked from gov.uk.

there will of course be a massive waiting list. As I said, look into moving to where you can afford rents.
