Next door won't replace their fence

Wwyd?

It's "theirs" and yet it's in such a bad way it impacts us so much.
A) every panel is different/botched/different heights

B) it snakes up the garden because they're falling down and just been propped

C) we're laying a new patio but struggling to get a straight line

We asked them last year twice. They refused. What can we do?

So, you don't want to put up a new fence because they'd benefit? Maybe they feel the same? They're obviously not bothered by their fence. If you are, then build your own so you don't have to look at it. Or plant hedges as suggested by PP.

Honesty OP, first world problems and all that Hmm It's a fence. Might cost a few hundred pounds to put up your own inside the boundary. If it bothers you that's what you'll have to do because they obviously aren't going to replace theirs 🤷🏼‍♀️

We have the opposite problem with ours. We replaced two sides last year and then they insisted the boundary fence was ours too, deeds suggest otherwise (and that they are taken a huge amount of our land), they are stating that it was agreed previously it was ours.

We have tried getting quotes but everyone hasn't got back to us. Honestly pissed off though as the neighbours always insists that everything is our responsibility as "prior agreement" before we moved in. It will take a whack of the money we had saved for other plans and I'm really resentful to be honest.

Thre is absolutely nothing you can do about it. My neighbour repeatedly let his fence fall on my flower bed sqaushing my plants and refused to touch it or put it back in his garden.
In the end I decided there is no point being angry all the time, life is too short and asked him if I could replace it which I did at my own expense with a very nice quality fence.
It was worth the money to have my peace and quiet back and not have to look at the horrible old fence.
Nobody is obliged to do anything with their boundary.

I feel your pain, our NDNs fence got damaged in the recent winds and is very precarious, I do feel that DH is going to end up fixing it.

We have neighbours who couldn't care less about their garden, so we've ended spending hundreds of pounds planting hedging and replacing panels on the side they are meant to maintain because of their eyesore of a fence which has now almost all fall down. We're also going to replace the fence along the front which they're meant to maintain, but have left falling over and broken for over a year.

It's unfair, but not worth getting angry about, and we figured that there are far more important things to worry about.

There’s nothing particularly unfair about it, really. They don’t have to erect a fence. If you want one; you provide one.

Well perhaps they don't have the money to replace the fence.

I have a shared garden. My neighbour won't allow me to put up and comoletely pay for a fence to split the gardens so I can keep my dog and children contained and off his property, even although he wants the garden to be split Hmm absolutely nothing I can do about that.

If you share a garden and have dual access you cannot hive off a section! If you own the land outright, of course you can fence it. Everyone has to think about circumstances with pets and children.

Build your own fence then. They aren’t legally obliged to do it. I’m not sure why you’re so reticent to put your own fence up when you seem to expect them to pay out for theirs? Put your own up then you can 💯 control it’s maintenance and how it looks. Problem solved.

The thing is op your options are limited and being arsey isn’t going to change it.

You want them to fix their fence so you can benefit. They don’t want to. They don’t have to, you can build a fence but you don’t want to, you don’t have to.

Either build a fence or put up with theirs.

You know they aren't going to look after the fence.

They aren't bothered about the fence and you are bothered about the fence.

So if you want a different fence you need to build one on your boundary. They won't be getting any joy from it because they aren't interested in fences like you are.

Op, has it occurred to you that they may have other calls in their funds. That a fence that is still upright does the job and doesn’t need replacing.

Or do you only think about what you want?

Being able to afford something doesn’t necessarily mean you will choose to invest in it, op. They clearly have no interest in what the fence looks like, rather than unable to pay for a new one.
Makes no difference, from your perspective. They’re not the one’s with a problem; you are.

Op as said, they don’t want to replace it and they don’t have to. You’re the exact same, you don’t want to build one either and you don’t have to.

The only person it’s bothering is you though.

I understand your frustration op it's their side that they are supposed to upkeep and they can't be bothered. Not a lot you can do. Shame this windy weather we've been having hasn't blown it over. Smile id be inclined to replace it on my boundary giving them the uglier side and then paint it bright blue so it drips through their side and looks shitty. Grin

In many streets it is clear who is responsible fir maintaining the fences at the back of houses. It’s not rocket science and it’s simply good manners to maintain your fence. You don’t have to but it shows respect if you do. House ownership costs money and always has done. A decent neighbour would explain if they could not afford to put the fence straight and rectify the problems. Just leaving it tilting on someone else’s property is not fair or acceptable. People don’t accept their obligations these days and try and get away with others paying.

I had exactly the same in two rental properties I used to own. Not my fence but shitty owners let them fall down and do nothing about it. My families had children and I didn’t want them putting up with no fence. So I paid. Fortunately where I have lived I had no issues with neighbours but I know there are lazy ones who just don’t respect you or your property. They don’t even value you as neighbours. Putting up your own fence is the only answer. Then at least you won’t look at their tat and you won’t have to speak to them.

As it bothers you that much, I would speak to them about removing theirs and you paying for a new one to go on the boundary. We had to do this when our neighbour chopped down the jointly owned hedge from 7 foot to 3 foot whilst we were at work! As our daughters bedroom was that side of the house we didn’t have a lot of choice.
