Viewings - how honest would you be ?

So basically I’m trying to buy the house off ex, who is trying to sell it under value.
We are back in court 30/7 so effectively nothing can happen until then anyway, no solicitor is going to let them exchange contracts with me in occupancy.
Would you tell people viewing ?

I'd want to know. I'd want to know what I was getting in the middle of so that I could walk away and not fall in love with the house.

I wonder if people could take action against him if they instructed solicitors and valuations when he knows he can’t sell

You can often tell just by the photos (total mess, no effort made) that the seller is in a divorce/won't sell situation

In that case I'd tell viewers immediately.

Well it's up to you about the photos. Obviously it makes the house more sellable if you have good pics - which is why the half of the couple who doesn't want to sell usually makes sure there are either
No photos
Or
Photos that make it clear at least one person doesn't want to move
It pre-warns potential buyers.

I'd keep everything tidy but be tactfully honest with viewers. It's tempting to enflame the situation by being obstructive, but this could fuel your ex's determination to sell from under you and could make potential buyers offer below market value in the hope your ex will cut and run.

Polite, tactful honesty is difficult to argue with though...

I had a lodger who moved out a year before I wanted to move.

I had to prove he was no longer living there in order to sell but I'm not sure if this was EA or, more likely, solicitors.

I'm not sure how this affects you but, unless he has an order for you to move, I am pretty sure you are well within your rights to inform viewers that you live there and have no intention of moving.

The bastard can agree a sale but it won't go anywhere. Even his solicitor won't take instruction unless he can prove vacant possession.

Do you not know anyone who can mess him about by putting an offer in?

I even had to get my 18 year old daughter to sign to say she agreed to move before I could sell my house.
