title deeds, the mortgage company has them

We need to replace our shared fence, and looking at the threads on here about fence ownership it seems that most people recommend looking at the title deeds to see who is responsible for it. But I don't have our deeds, the mortage company does. I thought this was fairly standard that until you own the property the mortgage company holds the deeds?

Can you get duplicate copies? Do most people have a copy in their house? I'm in Scotland so probably slightly different system here than rest of UK. I just feel a bit niave for never having thought of this before!

You should have been sent a copy of the title information document at the time you purchased.

However you can go on the Land Registry site and download copies of what you need for a small fee.

I'm in Scotland and we have ours, in our name and no mention of the mortgage company. I guess because we'll be changing mortgages regularly?

Ftb so not sure how normal this is.

Thanks. I'll download the stuff from that link tonight and see if it tells me what I need to know about the fences. We will pay off our mortgage in the next few years and I'll presumably get the full deeds then.

It depends what there is to be honest. Some lenders hold no more than a Title Information Document. Some properties have no “deeds” in the traditional sense.

They should however send you/your solicitor anything they hold so you/your solicitor can discharge the charge at the Land Registry.

In England you don't get sent physical deeds when you pay your mortgage off now. Everything is done online by the land registry. Not sure about Scotland.

It depends how old the mortgage is. Some lenders still hold a deeds pack. The next person who gets a mortgage on the house though won’t have to send everything to the lender.

Lenders very seldom hold the title deeds now
Easy to order a copy of the title sheet from ROS.

The interest of the mortgage company is stated on Section c of the Title sheet,if its not there ,then there is not a secured loan
