Hello.

We have a problem with our neighbour and need some advice. Below our flat is a guitar shop with no soundproofing. I have spoken to the owner several times about the noise and the impact it is having, but it has made no difference, he said they will play for as long and as loud as they want!
We are always on edge as the noise is random, it can also make our flat shake. The noise is affecting our health now and we have had to speak to the GP about it several times. My wife is getting very stressed, I am also feeling the stress and our 8-year-old screams with the noise and cry’s, it’s also affecting our relationship, I feel so helpless.

I have been looking online at the information on our local council site and it stated that we need to record how often the noise is, how long and how loud but they may not be able to do anything if the noise is not seen to be often enough, if that was the case, would we just have to suffer with it or is there anything else we could do?

The council will have no interest if the noise is between 8am and 11pm.

More fool you for moving above a music shop and expecting it to be quiet.

If it's not enough for council action then you can only move, you must have been pretty annoyed when they opened, I know I would of been.

Did you know there was a guitar shop below when you moved in?

I would imagine that if the noise is within reasonable hours, so between say 9-6 a complaint wouldn’t be upheld.

In all honesty, I would look to move. I’ve lived under noisy neighbours and it nearly drove me insane.

So did you move before or after it was a guitar shop? If you moved there knowing then sorry but that was too clever! You will have to suck it up and chuck a couple of cheeky requests in do a bit of air guitar to lighten the mood.

If the shop was there when you moved in then I don't really think you have a leg to stand on to be honest.

Maybe they hope somebody can help them pull a few strings to get it sorted, one thing is for sure though, a solution won't be plucked out if thin air.

Eh? Does your 8yo have noise sensory issues?

Are the guitar shop giving music lessons ?
My DS goes to guitar class and if the noise was as bad as to make someone on another floor scream, he wouldn't be in the room.

Thick carpet and underlay for a start .Help absorb the sound .

And , who was there first - you or the shop?

I am going to assume, perhaps wrongly, that the guitar shop was there before you. If you choose to live above it, you can’t then expect them not to play guitars.

Is this the same flat as you are in now?
Sounds like huge sound proofing issues in the whole building.

Who is responsible for the maintenance of the building?

I don’t mean to be rude OP but really, a flat above a guitar shop was never going to be condusive to a peaceful family home was it?

To all the replies, not everyone has such a free choice of places to live. Please check your privilege before replying.
To the OP, sorry you're having to deal with this, and it makes no difference who moved in firs a nuisance is a nuisance regardless and the council can enforce.
It doesn't have to be at night although that would be a strong exacerbation. They have to balance the rights of both sides.
Talk to the council first and explain, they will have an investigation team who has the power to them place limits on the activity and in the worst case get an injunction. But start with them.
