Neighbours building on my garden wall

So the neighbours in the next road but at the bottom of my garden have decided to build some kind of shelter and attach it to my garden wall. This now means it would be easier for intruders to gain access to the back of my house and would also stop me from building on the wall from my side if I wanted to which I think is unreasonable. Especially since they didn't bother to knock and ask if I would mind beforehand.

I'd like to go round there and question them, but do I have leg to stand on or are they just being cheeky?

If they’re building something, did they need permission for it?

Assuming you own the wall, they aren’t permitted to attach anything to it. Check your deeds to make sure it’s your wall, then get your solicitor to send them a letter demanding they remove anything that’s attached to your wall.

Is it in your garden or is it on the party line?
If it’s on the party line, the side on their garden belongs to them and they can do as they wish.

What have they built? & I agree they should have knocked and discussed with you first , people have lost all manners.

No they cant attach things to your wall

Check your deeds to see who owns it.

If it's their wall they can build on it. If it's your wall, or jointly owned, they can't build on it without your permission. If the latter, write them a letter giving them 10 (?) days to remove their building or you will be taking further legal action. Send it recorded delivery.

Thanks for the replies so far, I will add a photo when they have gone in, that's how obvious it is.

I'm not sure if it's the party line or not, one side is my garden, the other is their driveway.

I'm also not sure what they are using it for, but I have friends in the same area that have had planning permission refused because it takes away their parking spaces which is fair enough, but I don't know if this would be the case as I can't see either end to know if doors are attached and so could be a shelter for a car.

They've attached one side to their house and angled it so the lower side is attached to the wall. I can't imagine someone wouldn't look into all this before building and even if perfectly legal I do still think it's common courtesy to ask.

party wall -whether or not it is shared ownership - look it up - I think they might have to request your permission

Will it even support the weight if they're building a structure? Garden walls aren't usually built to be load bearing.

The wall must be built two bricks deep as the top bricks are one brick length at the top so I'm assuming one brick is mine and one is there's but then doesn't account for the top brick.

They would have had to drill into the wall as there are brackets up. The structure is easily over 12ft long, but not all of it rests on my garden wall and rests on next doors too so will be asking if they have knocked there to discuss with her.

Like I say if it's allowed then there's nothing I can do and not much I can say, but a conversation would have been polite. Especially since they are loud (building and shouting) and sitting on it with full view into my garden and house, charming!

Apologies Mumwon, I misread, thank you so much for the link. I'll be discussing with OH what we want to do now we have the facts as we'd like an extension and to perhaps build at the bottom of the garden and don't want to make enemies over a bit of wall (we would of course go the right way about gaining correct permission and all the planning we needed). Will walk round there tomorrow to see what they've actually done too. Thanks again!
