When do we change the deeds?

A bit confused about this one, so any advice would be good.

We are building an extension (at some point in the next year). We havepall the permissions but haven't got the builder yet.

Our neighbours (who are selling their house) have rights of access over our property, the route of which will have to change once we have built. The route it will change to will only exist once the extension is started as it involves knocking down sheds.

The neighbours want us to change our deeds to reflect the new route of access immediately as their purchaser want to guarantee them having access.

When would you get the deeds changed?

Does the existing deed define the exact route? Generally not, just that you must five access to fulfil a function,mid to reach their property. Therefore the Sita ion want change?

Tricky - assuming that the existing deed is specific (which most are likely to be). The best thing, given that the neighbours are moving and you don't know whether the new ones will sign anything is to put a new deed in place showing both the existing ROW and also the new one and with wording (which your lawyer should be able to do) to say that the original route is the one until the works are done etc etc.

The existing route is specific.

The route will only change by a maximum of 5 metres going down the side of extension rather than of existing house.

The access is for the neighbours to put out their bins. So there is no question of them objecting to it.

Their lawyer should be able to advise what is required - I would think that a plan showing the old and new routes and a declaration from you that a route will be provided should be sufficient. It could actually be without a plan if the description of the new route is clear enough.
