New Build fencing of borderline

Hi All,

Hope you can help. We are currently waiting on our new build to be built (completion Dec 2019). We have had some issues already with them not giving us a full workable garden but actually raising the far end and putting shrubs there (we originally got shown plans that the land was flat to the end). That issue is kind of sorted.

But now, they have erected a fence right at the back of the garden- which is correct. However, they are almost a metre away from the land we are actually deeded to. As this is marked out by small posts. there is a house behind half our garden and the other half is farmland (which will be developed on)
We have raised this with the site manager who seems very blase about it, but we are really annoyed/ upset that they are essentially not marking out the land we are deeded to correctly and it will be lost land. Its quite a bit of land, not small amount. Has anyone else experienced this?

Ask them how much they are reducing the price by to reflect the smaller garden...

My new build that backs on to farm land...the developers have put the fence back from my legal boundary as they have to plant a natural (mixed native species) hedge along rear for wildlife. This was part of original planning requirement.

Technically the hedge will be on my land, but putting it just outside of my fenced garden is better for wildlife. Could this be something similar?

We had something similar. Call the head office or go into the sales office if it is still on the site.

Just keep on til they sort it.

Have you checked the planning permission drawings? It may be that the fence is set back to provide a wildlife run behind or watercourse.

It may be that it is a 'landscape barrier' for wildlife or to offset the look the development in the landscape.

We have a new build alongside our side boundary in what was a field the developers built the fence probably a metre on the far side of what was the old field boundary, so that there's a metre of weedy 'lost land' between their fence and ours you can see the old fenceposts of the field boundary from before either of our houses were built, from when the whole area was farmland. When I queried this with the developer, he said that their measurements were more accurate than the original field boundary ie. the new build's fence is in the right place and that he recommended that we just annex the 'extra' ground between their fence and ours by adverse possession.

Hi

There are no wildlife issues. The boundary is marked by green pegs. They have put the fence metre and a half infron of the pegs purely for their own ease and convenience and probably cost saving.

I have tried to google NHBC guidelines on boundaries but had no success. Are they legally bound to put the fence on my boundary. Surely they cant put the fence in front cutting the bi boundary by 15 tob25 square metres
