Scottish boundary law

First time poster, long time lurker.

I'm in a semi-detached, with toddler twins. When we bought the house (13 years ago), it came with a large extension running along the back of the house. It goes right up to the boundary with the house next door, although the architects assure me that it's 100% on my side.

It's no longer fit for purpose, and we have a building warrant to replace it with an extension. This will be exactly the same size as the current one, but will extend out further from the house by about a metre. The issue is that the neighbour's fence runs along the boundary.

I'm sure they're reasonable people, but I suffer terribly with anxiety (medicated) and husband is like a bull in a china shop. I work shifts so rarely see them. How do I go about telling them I need to remove a small section? This may be a trivial post, but it's really upsetting me. I grew up in a street with horrible, violent neighbours and I'm terrified that this is going to end up as a feud.

We're in Scotland, so party wall etc doesn't apply. What's the easiest way of bringing up the topic? At the end of the day, I know I'm 100% legally entitled to build in that space, but I don't want to cause bad blood.

Surely you need to ask them if they will be okay with you removing a small section of their fence? Will it be replaced or will your extension wall replace it on the boundary?

forget extension wall for a minute - will the foundation go over to the neighbours side ?

WeeCharlotte · 08/07/2019 20:21

Oh dear. Foundations are something I hadn't even considered. I just assumed they'd automatically be on our side. Is it common to cross over the boundary???

WeeCharlotte before my neighbours started their extension, that was going to encroach on me, they invited me round for dinner. I thought they were going to bring the subject up as I had seen the planning application. But they didn’t mention it, I think I was there so they could suss me out or see if I brought the subject up. Bit baffling really. But the extension went ahead and all was fine.
