Aco drain gap

Our driveway slopes towards our house so theres an aco drain along the house wall. Over the weekend a builder mate pointed out that there's a half inch gap between the drive and the drain and another slight gap between the drain and the house. I've never noticed or thought about it before but I guess this effectively renders the drain useless. We've lived here 8 years and AFAIK it's always been this way, but builder mate reckons it's a bit of an issue especially as we are on clay soil. He has offered to seal it all up for us but I am a little concerned about changing anything after it being that way for so long with no problems. He thinks we could be at risk of subsidence if we leave it, but my thinking is that it's no different to rain soaking into the flower beds along the front of our house, and what if it has the opposite effect and causes heave? So do any of you kind people know about aco drains and can advise? House is about 25 years old if that makes a difference.

Should also add that said driveway is shared between 5 houses, but we all own a portion each and just have to make sure we don't obstruct. Presumably I would be allowed to have work done on my part including the drain without consulting the others?

It's probably fine, the drain is to prevent flooding not to be waterproof.
