New deposit cap when Tennant is on a rolling monthly contract

Can anyone explain if you are a Tennant, but didn’t renew and sign a periodic tenancy agreement. The tenancy is now a rolling periodic tenancy and has been for years. The original deposit was two months, held with the dps. No agency involved any more. Is the Tennant due a refund?

You arent due the deposit until you move out. The estate agent should have transferred the deposit in the landlords name to be held with the DPS

The cap applies to new tenancies from 1 June so rolling contracts signed before that date are excluded and the original deposit will continue to be held.

You don't sign a rolling contract.

When an original AST is signed, and the deposit is insured the length of the original AST is specified in the deposit paperwork. At the end of the AST the tenant is automatically moved onto a rolling/ periodic contract unless a new AST is signed up for. The landlord doesn't have to do anything with the deposit, that also moves automatically to match the rolling/ periodic contract unless something else is specified. No money is due to be paid from either party, and nothing is due to be repaid unless the tenancy is ended via a notice period.
