Fucked up situation with estate agent - what to do??

Long story short - agent A showed us round a house. At the end of the viewing the agent left a side door unlocked and the seller sacked them. It is still on the market with agent B (dual agency). We want to have a second viewing with a view to making an offer but the second agent B isn't interested in dealing with us because they won't get any commission and the sellers won't deal with the old agent. What do we do?!

Have you given your name to agent B? Can your other half call agent B and give their name to book a viewing as if you were new viewers?

Well yes, that would be the best thing, but there is literally nothing else suitable on the market right now. And I've had my eye on this house for 7 years Grin

Isn't the agent legally obliged to pass on your offer?

Knock on the door and ask the sellers who they would like you to deal with. If they want an offer from you then they’ll sort out an agent for you to deal with.

Pop a note through the door to the vendors explaining the situation and asking for a second viewing.
If you go ahead they'll have to pay EA1 the commission but not the end of the world.

Yes I thought the agents had to pass on all offers regardless. However they could make a viewing difficult. You could put an offer in and then if it's accepted view the house again. If you change your mind after this viewing then withdraw your offer. Alternatively knock on the door and speak to the owners.

Thanks for the replies. The owners aren't living there, so we've put a note through the door, but not sure how often they're checking the house. Fingers crossed

We had something similar, although EA1 was stringing us along on another property and made all sorts of excuses why he hadn’t been able to pass on our offer on our house we are in now. House was also with another agent. We went there and made the offer. EA2 was able to ring seller, ring me back and do negotiation all within 30 minutes and an offer was agreed. EA1 had been saying he couldn’t get hold of seller, not answering phone, email and supposedly personally popped offer through her letterbox. Yet EA2 could do the deal in 30 minutes.

EA1 furious but somehow they worked it out between them about payment. As buyer, wasn’t involved in that. EA2 did the deal though.

If your EA2 won’t pass on your offer, I’d write the letter as previous suggested. But truthfully, this type of scenario would be covered in their contracts and EA2 should be passing on your offer. They’re Not acting in best interests of his customer (seller).
