To not disclose knotweed?

Hi all,

We bought a new build flat (leasehold) 16months ago and are in the process of selling to buy a freehold (expanding family).

When buying there was no TA6 and we had no idea what knotweed was. Nothing was ever picked up on a survey.

We have got buyers and I have filled out the TA6 form. The neighbouring flats (number 30) has knotweed in their garden. We found out by suspicion and then a search on the council website. It has a 10 year treatment plan in place (freehold of both blocks owned by same company). We are number 32, directly next door. As far as I'm aware we do not have knotweed, there's nothing to suggest we do. I put 'don't know' on the TA6 form as I genuinely cannot tell you whether there's knotweed on our property as we don't have a garden and we have no access to the neighbour.

The buyers have had their survey and I've not had any questions on this. Their side of the conveyancing process is complete (we are in a chain)

Is this legally OK or would I need to say? I don't want to if I don't have to.

I explained to the solicitor when I was filling out TA6 and she said 'it says YOUR PROPERTY' and as far as i'm aware, my property is unaffected.

If you don't have a garden, where would the knotweed grow? Genuine question.
You haven't lied. I wouldn't worry about it

Are you on the ground floor next to them but with no garden?

@baby yes, ground floor, it's converted buildings (shops into housing), the building has one wall slightly attached (hard to explain, not a typical semi detached style). Our bedroom window opens into the neighbours garden (this is the part where the building stops being attached). The garden is small and it's that property that has the knotweed.

None of the flats in my block have a garden. We have a shared car park with allocated spaces. There's 6 flats in our block and 3 in the neighbours.

Your property does not have knotweed, so no need to disclose anything.
