End of tenancy deposit return

I'm hoping someone can help me.

I left my rental on 22/12 and when sending the letter my my agent to inform of my ending of tenancy agreement asked for the deposit to be returned within 10days.

The independent inventory man came and did the checkout and said he was hoping to get the report back to the agents on the same day (22nd)

It's now been over 10 days and I haven't heard a thing, I've checked TDS and there's no disputes raised.

Everywhere I look it says the deposit must be returned within 10 days of agreeing how much will be returned or the disputed amount goes to dispute resolution. What I can't find is anything that says but the landlord has...?? Days/months to respond/ return the deposit.

I'm reluctant to call my agent as the landlord was really shitty and I just want all my money back, I left that place in better condition than when I moved in!

Does anybody know how long the landlord has? Any links would be appreciated Smile

When we moved out of our rental property, our landlord had 30 days to assess the property, tell us what he was giving us back/if any repairs needed doing, and then the money had to be returned to us by the 30 days.

Landlord took out a deposit protection plan which told us that from the day we left, he had 30 days to tell us what we would get or return in full.

Does the TDS website have a button on the website where you can request the return of your deposit? When I left my last rented house I just did that, at the recommendation of the woman who did the checkout inspection. It starts the clock and puts the onus on them to justify any deductions they want to make, otherwise (at least in my scheme which was one of the Scottish ones) you automatically get your full deposit back after a set amount of time.

From the top of my head I think landlords have 30 days or so to inform you of any deductions and then 10 days after they are agreed to actually return the deposit. But given you moved out just before Christmas, I shouldn't think many working days have actually passed yet. You might find the delay is with the deposit company who don't tend to be the fastest anyway, and have probably only just gone back to work this week.

I sympathise, it is frustrating waiting for a deposit back.

Thanks cupcake are you in England? I'm finding it impossible to actually get evidence of this.
Vegi I asked TDS but they said they're just insurance for the deposit and the money is still being held by the letting agent (I'm guessing so they can get interest off of it!)

@probablynotthesame Yes I'm in the UK. Check your tenancy contract and see if there is anything in there.

Also check who is was paid to - landlord or estate agent as they might have different rules on how long it can be to get it back.

In that case I have no idea, sorry! There must be some sort of time limit though otherwise they could just leave it hanging and keep your money forever.
