Hi all

I know MN loves a parking thread! Looking for some advice on a situation many will suffer with. We live in an area of Victorian semi's and predictably parking is an issue. We must be the only household on our bit of the street with only one car, others have two or three. When events are on locally the situation gets even more pressured, several houses are having extensive building work done so lots of vans etc and the house opposite was converted to office space meaning 2-3 workers and their cars as well. Parking near the house can be hard, which didn't used to be an issue but now with a toddler and a baby to manoever safely in and out has become more of an problem. Our house has a driveway with a dropped kerb to the side of the house. This legally belongs to our house but the deeds state right of access for neighbours for them to get to their rear of their property. The leads down to a garage (ours) but in the past both houses have been extended slightly to the side before our time which means it's too narrow to get a car down. Question is - are we within our rights to park on the drive, as long as neighbours can walk past the car? We never really have in the past so it feels like we're in the wrong to start now. I feel like I have to apologise for it, it also means having to sometimes shift the neighbours bins back to fit the car on as they choose to keep them at the top of the drive. But should their bins even be there (right of access doesn't extend to storage?) or should they be keeping them on their own property, as long as they can get them in and out for collection? Am I in the right to park there?

Whether or not it's within your legal rights, I would want to talk to neighbours about the situation. They are the ones who could kick off & make a stressful fuss. Try to make them feel consulted.

It's your drive. You can park there as long as the neighbours have access.

What is the wording regarding the access on your deeds? The devil is in the detail.

Read the deeds carefully, if all they have is access to walk over the drive, then they can't store bins on it, it isn't a shared drive it's yours for parking on.

It depends whether their access is on foot or vehicular. If it's on only foot acces and you aren't preventing it, I don't see any issue. Check your deeds and there's, both available from the land registry online for about three quid.

As for the bins, if it's your drive and they only have foot access the bins have to go.
