Conveyancer deadlock

Hello
Does anyone know what happens if two conveyancers disagree on an issue and neither will back down?

I am buying a new build flat in the
NW and my solicitor is insisting on a clause that the developers solicitor is refusing to include.

What happens now? I'm pretty stressed about it all.

Your solicitor needs to advise you of the risk and the likelihood that it will be a problem. Then you need to make a decision as to whether you’re prepared to accept it.

It may be something that your mortgage provider has a policy of not accepting, in which case you need to find a different mortgage or a different house.

Thanks Damson, it's a weird one, to do with liability on construction standards. I don't know what the lender will say - maybe that's the next step.

What worries me is the 28 days to exchange policy. We are still within deadline but I don't want the developers to pull out..

If so, run away. Find somewhere else built by a company that'll stand by its work.

I would consider this very carefully and ask your solicitor to explain to you the implications of not having that clause inserted.
It could leave you covering huge costs.

Developers Solicitors are well known for being arseholes, even when their paperwork is not in order. You want the paperwork to be correct as when you come to sell you want to be able to do so without problems and without costing you money. I’m sure your lender will want it to be in order. It sounds like your legal representative is doing a good job and not just rushing it through.

That's what I would be thinking. Be careful and I would definitely trust your solicitor on this.

Thanks all. I'm a FTB so finding all of this miserably stressful. Got to be prepared to walk away I guess.
