EA sent details to my ex

I want to throw up and need to vent as the office is closed for the day.

I'm selling my home. It was awarded to me as part of divorce. Exs name is still on until i sell. Which I'm doing.

I'm purchasing a property in my name only. I don't want ex to know the address as he's controlling (especially financially) and he was abusive. Without going into detail he did not get the dcs overnight for a couple of years until he could prove he wasn't a threat.

My Estste agent has named my ex as a purchaser and has sent out copies of the document to him which includes the address of the house im buying, vendor details and my solicitor details,

I did not want him to know any of this.

I've immediately gone into a catastrophing mindset. Is this as bad as I fear?

I think they are lying because sending an ex info like that could cost them thousands in fines from the information commissioner and you can sue too. So report them to the information commissioners office - ico.org.uk/make-a-complaint/

Only you know how bad it is for your ex to have this information. I wouldn't be able to purchase the property with my ex knowing - it would be too dangerous.

KeiTeNgeNge · 24/08/2018 21:21

Report them. Why would they tell you they had sent info to him then suddenly discover they hadn’t as soon as you complained - sounds dodgy as hell to me.

FishesThatFly · 24/08/2018 21:22

I smell bullshit, they'd have sent his info out the same time as yours

MeMeMeow85 · 24/08/2018 22:07

Sorry to hear that OP. It sounds like they are backtracking now. I’d pull out of the purchase. Wishing you luck with your search

TiredPony · 24/08/2018 22:16

So, they told you they'd sent it and once confronted said they haven't sent it? Sounds suspect. They would post them all out together. Is it the Memorandum of Sale? How do they have his address, is he still living with you? I think you need to go in and speak to the office manager tomorrow, make it clear what the risk to you is and it may affect your purchase.

HoleyCoMoley · 24/08/2018 22:19

You need written confirmation that they didn't send it, it sounds a bit suspect, how would they have his address.

MaggiePhilbinsSwapShop · 24/08/2018 22:24

Report to the ICO anyway, I agree they are lying. Also speak to your conveyancing solicitors asap.
I felt sick for you on reading this

The sale memorial is sent by the agent you are buying through, not your selling agent.
They may have supplied details incorrectly but everyone should get the documents
Is your ex’s address anywhere on the docs you’ve been sent? If not he probably hasn’t got them.
Not great service though, but can’t see how it is your agent’s fault - are you buying through them as well?

TheCrowFromBelow · 24/08/2018 22:58

*memorandum not memorial Hmm

NaomiNagata · 24/08/2018 23:02

This is just not nice to hear. I really hope it works out for you and they actually didn't

If they did, then get all the compensation you can for having to give up the house you want.

Mynamesjohnnyutah · 25/08/2018 09:17

I don’t understand why you think they would have his mailing address?

bastardkitty · 25/08/2018 09:20

How could they sell a jointly owned property without it?

Mynamesjohnnyutah · 25/08/2018 10:14

Oh right... ignore me!Blush

DanielCraigsUnderpants · 25/08/2018 12:34

I think they're lying too

AsleepAllDay · 25/08/2018 12:59

Report it OP - they were presumably telling the truth when they told you they had sent them so a lie to cover it up is more than likely

SassitudeandSparkle · 25/08/2018 13:05

I'm also thinking it is a Memorandum of Sale - are you selling your own property and buying the new one through the same EA, otherwise the vendor's EA would not have your ex's details Hmm

AnalyticalChick · 25/08/2018 13:25

It is common practice to lie to cover up a mistake. I have experienced it even from solicitors, let alone EAs (who are notorious for lying).

ThroughThickAndThin01 · 25/08/2018 13:33

You are presumably then using the same agent for sale and purchase? I don’t really understand the scenario.

It would be impossible for them to lie and not get caught out because ex would have the piece of paper waving in his hand. They probably haven’t sent anything.

wowfudge · 25/08/2018 14:54

They use email. Why is this situation so hard for some people to understand? Why would the OP make contact with her ex given what she has said about the relationship? He is unlikely, unless he's really stupid, to show his hand straightaway.

BackToTheFuschia7 · 25/08/2018 16:47

How awful. They’ve really ballsed this up and I wouldn’t believe them about not actually sending it. Definitely agree to report to the ICO.

I don’t see how you have any choice but to pull out of the purchase now? Would your ex reveal he knew straight away or is he malicious enough to keep it up his sleeve?
