Hello everyone
Hope you can help me
I am owner of flat. Our development are small (7 flats) and we have share of freehold. Our lease has reference to obtaining prior consent before you can keep a pet. There are already 2 pets in our development. One dog and one cat. No pet cause any inconvenience or troubles and nobody ever complained. Me and my partner decided to extend our family and get a dog. We asked our neighbors about granting permission and were devasted when our request was rejected. When we asked for explanation we didn’t receive any fair reasons why not. Our development is converted victorian house. I live on the ground floor with own private door and private patio. I feel discriminated with outcome because everyone should have equality, our development is not pet free and I see no reasons why I can’t enjoy my property fully as others do. What must be my next step? Thank you very much in advance.

if the neighbours are able to object and have, nothing you can do.

perhaps they are concerned about all day barking?

not a lot you can do, most pet clauses are denied unless it's a therepy animal. you didn't get the dog before you asked for permission did u?

Our neighbor already have a dog. Their dog is lovely, never barked. Literally
Maybe they think that that dog is unique, I really don’t know

On the face of it, giving permission for one but not another seems unreasonable. What is the exact wording of the clause? Have the other neighbours actually obtained permission?

The other neighbours maybe ignored the clause and didn't ask permission.

Do you have a management committee, who decided you couldnt have a dog, was it voted on. I would ask for a reason, and also ask why the others were allowed and you're not.

Yes, they asked permission and received. I personally approved existing dog. I didn’t approve cat because I simply bought my flat when neighbor with a cat already lived in the development

We are all directors of the management company. There is no head of comitee. We just use one neighbor for correspondence who is dealing with others us a letterbox. They voted 3 in favour and 4 against.I miss one vote. I didn’t receive any reasonable explanation from them.

The lease wording are “Not at any time to keep any animals or pets on or at the Premises except with the prior written consent of the Landlord which consent may be revoked at any time by notice at the discretion of the Landlord”

Also all of them are great people. Really. We live together for 4 years and everyone so nice to each other. Never ever any concerns or problems

We were all 'Directors' of the management company of our block of flats and had to take votes on any issues but we held proper meetings with all the residents which were minuted and any personal requests were always in writing. I don't know the answer. It does sound a shame though.

We are the same, we have meeting once a year, dealing with our finances ( communal areas, repairs,etc)

If I were you I'd call a meeting of the occupants, and ask whether you are going to be a dog free building or not. It's harder for people to be unreasonable in person, as they have nowhere to hide. For your neighbour to be allowed a dog and you not, especially as you are on the ground floor.

Her voice is important but she told me that her cat doesn’t like dogs. I know how funny it sounds but I lost my sense of humour

Others didn’t provide reasonable explanation just told me that they feel sorry and we must obey majority

Her cat doesn't like dogs, maybe the dog there doesn't like her cat. You are on the ground floor, your dog will always be supervised and not let out in the communal areas alone. She is being precious and I love cats.

The others may feel different if her cat doesn't like cats either and they want a pet in the future, you all have an equal voice, maybe she thinks her puss has an equal vote too.

Thank you very much much for your support HoleyCoMoley, I told her all of that, reassured everyone in the very first request that there will be no disturbance to anyone from my side. Mentioned my location, everything. And we got what we got
