Vendor blocked the house's legal right of way - help!

Buying an end terrace hopefully. The vendor put in entrance to ally to the left of the house, which is a right of way for houses on the next street (their gardens back on to it) which they do not use. He then fenced off the legal right of way which goes across the next two houses, because apparently they started using the new right of way he made and were leaving the gate open or something. - I attached screenshot.

I assumed that I could still use the original legal right of way (in the deeds) if for some reason something happened so I could not use the unofficial right of way (not sure what that would be, but would want to be on safe side). But solicitor saying that because the vendor put the fence up, the right of way would be lost. The building society is asking for confirmation of a right of way.

Anyone know of any situations like this and anything can do? Sad

The Land Registry is likely to have it as a right of way, which is why the mortgage company is checking. Your solicitor/conveyancer would need to advise really.

Its def on the land registry but the vendor blocked it off. The one the vendor is using for the houses on the next street.

just talked to solicitor, said the fencing off could mean that right of way is lost - said it would depend on a court if neighbours objected to putting it back in again.
