AIBU - Landlord still using our house address for their mail

Does anyone know if this is a big no no or do I just have to suck it up as annoying?

So we've been renting our lovely house for a couple of years and take very good care of it and are good tenants. All in all we've had no problems so count ourselves lucky but one thing is really bugging me.
Our landlord still regularly has post arriving here. Most of it's just junk so I just bin the obvious stuff but there are still bank statements and mortgage statements every now and then, which really bothers me. Should he still be using our address for these things?

I generally collect a small pile of the post and every now and then dump it round to the estate agent. This week, the agent has been chasing us on behalf of the landlord several times to see if there has been any post for him. There hasn't, so I've replied no. Today I realise why, post has arrived and i'm pretty sure it's a credit card in there. Obviously i'll drop it round to the agents asap, but am I wrong to be really annoyed? Both by being chased and by her still using this address?

Thanks in advance guys!

Just return to sender. In a post box, no stamp required.

If they're getting mortgage statements delivered there, it's likely that they've not got permission from their lender to rent it out. I'd be tempted to innocently tell the agent you're going to start sending them back 'return to sender' and see what the reaction is...

Redglitter · 03/07/2018 15:47

I'd be sending it all back to sender. That should stop him

CaptainWentworth · 03/07/2018 15:47

borlottibeans may well be right! This happened to us - we were innocently forwarding post on via the letting agent until one day we had a letter addressed to ‘The Occupier’, which told us the flat was within weeks of being repossessed for non repayment of mortgage!

Turned into a massively stressful saga as it wasn’t a buy to let mortgage, no one knew there were tenants and we had no legal right to know what was going on with our home. Definitely follow this up with everyone involved before you end up in the same position we did!

I think be even more low key and 'innocently' say 'oh my DP has said he's been returning things to sender, given the landlord hasn't lived here for years. Hope that doesn't cause any inconvenience' and see what happens.

Using your address for a credit card is definitely not on. Is the landlord out of the country? That would be my guess, and thus probably not eligible for the credit card. (And the agency should be withholding part of the rent for taxes, although they probably do know where the landlord is if they're passing on the mail).

Sounds like he hasn't told the mortgage lender he's letting the house. This is a serious problem (for him) and ultimately you, if they find out (you may have to leave).

You're damned if you do and damned if you don't really.

I had a landlord doing this. As the property was well maintened and he was otherwise very reasonable I saw no reason to cause trouble and return it to sender/threaten the letting agent. We just kept in a pile and told him he was welcome to pop round for it and he came maybe 3 or 4 times in 18 months.

kingseat2016 · 04/07/2018 07:32

Just return to sender. Job done and you don’t need to tell the agent you are doing it.

specialsubject · 04/07/2018 08:54

red flag as others say. sooner or later the mortgage company will find out and you will be evicted in the repossession. the agent is clearly complicit.

the place also wont be insured although not your problem as you insure your own stuff.

how are the other legals?

FabulousSophie · 04/07/2018 09:42

If as seems likely, there is a risk the mortgage company will find out whether or not you return the mail to sender, it is probably best for you to start thinking about alternative arrangements before they give you a months notice to quit.

FabulousSophie · 04/07/2018 09:47

Is the landlord giving you a special deal for renting an illegal property and covering their back?

wowfudge · 04/07/2018 09:58

The LL will have to give 2 month's notice, not one.

wowfudge · 04/07/2018 09:58

Rogue apostrophe - thanks autocorrect
