Landlord refusing to fix window. Currently stuck open!

Hi. Posting for a friend. She's been renting a house for the last 18 months. Yesterday a window she had open refused to close. She thinks hinge has broken (20 year old double glazing) she called landlord who has said it's her fault/problem & she'll have to pay to replace. Surely that's not right. She can't leave the house as window stuck open & it's a burglary risk!

I would have thought this falls under repair & maintenance. It's not like she's broken it through incorrect operation or negligence etc...

My DH thinks he can get it closed but that it won't open again after. That'll be an issue next week in 30 degree heat with young children.

Friend has only had to report black mould before now in bathroom. House is a classic rental. Not been touched since the 90's, minimal upkeep.

Any advice appreciated

A window broken by misadventure would be the tenants responsibility but this should fall to the landlord yes. Does she have a contract?

Broken hinge is 100% down to the landlord to fix. It is also classed as an emergency repair I'm sure as it leaves the building unsafe.

@Kirsten I'm not 100% presume standard AST. But I used to rent recently & can't think of any clause that would make this tenant responsibility. It's not like she kicked it open or hung off it Grin. I'm pretty sure this will invalidate LL insurance too. Off to film DH close window in any case. (For proof not memories)
