Dad giving up flat.

Hi all,

I have a problem and hopefully some of you can offer some useful information to help me.
I’ll start from the top.

Me and my dad moved into a council Maisonette when I was 10 years old. I am now 26 and although I probably should have moved out by now I haven’t. I was working full time as a scaffolder but after an injury at work I am no longer able to work in such a demanding field and after working so long in construction am finding it difficult to find work elsewhere.
My dad has now met someone and has fallen head over heals in love. He has decided that he will marry her immediately and also move into her 2 bed bungalow with her son and sister.

My question is after my dad moves out can I take over the tenancy due to the fact I have spent most of my life here and if not is there any other housing options available for me or will I become homeless?

Is the tenancy a secure council tenancy?
And has it always been a sole tenancy (just in your dads name?) If so -as it started before the 1st April 2012 then your dad should be able to ask for the tenancy to be assigned to you but it must be done before he moves out. A deed of assignment should be used. Your dad would no longer have any rights to this property.

Please note if ever it was a joint tenancy (with your mum for instance) then the above doesn't apply.

You will need to contact your local council regarding this but it should be fairly straightforward. Good luck.
