Contractual Parking Charge Notice

Anyone had one of the above? We received this notice because my daughter exceeded the Permitted Free Parking (180 minutes). She was there for 267 minutes. The charge is for £85. They have a photograph of her car arriving and leaving the car park.

Can anyone tell me if this is an official notice and we have to pay?

Is it a penalty charge notice (from a traffic warden) or a parking charge notice (from a private company)?

Thank you for replying.

It's a parking charge notice for overstaying the time limit in a retail park, so am assuming it is from a private company, G24 Ltd.

Looking at Streetview, I can see that there is a sign at the entrance stating that parking is free for 180 minutes. While I do understand that you can ignore Parking Charge Notices in some instances, my daughter has clearly "broken the contract" by overstaying the time.

Do you have any knowledge as to our next steps? Thank you.

Was the PCN a yellow sticky on the windscreen or was it a Notice to Keeper through the post?

If the latter then check the date of the alleged offence and the date that the letter was sent, as there is a strict time limit for them to send.

It was a Notice to Keeper through the post. It was dated 4 days after the incident. However, it was posted to my address and my daughter moved out last year. I didn't open the letter until a second letter was received today (Final Notice). My daughter's driving licence shows her updated address so I have no idea why this notice was sent to this address.

Changing the address on her driving licence won't change the address the car is registered to - they are two different things.

I know a lot of people don't pay these fines. There is a risk to it though as sometimes these companies will take these fines to court to set an example, which could result in a potential CCJ for your daughter. I presume she has changed her driving license address but not the log book address

lava yes, that's what concerns me, so I think we need to write to the company refuting the charges.

We had one of these, i just wrote back with copies of the receipts from the shops which luckily we still had, and didn't hear anything further. I had no idea there was a limit, but it's a small retail park so normally you wouldn't spend so long. I was researching something in b&q plus i went to wilco and Lidl so luckily i was covered.

If your daughter spent time / money in stores and restaurants on the retail park then you could also try appealing to them to get the invoice waived.

Just to update:

My daughter had been looking at lounge furniture and bathroom fittings (she is moving house) and spent rather a large sum of money in Harveys on a new sofa, so she approached them about the penalty charge and they said that they would sort it out. Today we received confirmation that the charge had been cancelled. Great result!! One very happy daughter.
