Nuisance noise and laminate floors upstairs neighbours

Can anyone share their experience on nuisance noisy neighbours and putting wooden flooring down in flats above? I rent from a Housing association and have been complaining for nearly 18 months now and they say nothing can really be done and that taking them to court will not really work. Is this true? Should the landlord be responsible or should I look to taking them to court myself? If you have gone through this or are going through then please give me some advice. Thanks

What does the neighbour's tenancy agreement state about flooring? If they have breached the tenancy agreement then the HA needs to take action. Have you kept a noise diary and/or contacted environmental health about the noise?

I'm assuming that flat upstairs is rented but not from your HA?

Yes it’s rented from same Housing association. Our tenancy states that you need permission to lay laminate flooring first and not cause a nuisance. They did not get permission. I have a listening device in now from council but they state it’s a problem the landlord should be dealing with but they have not. The noises have ruined our lives it’s just awful. The tenants upstairs could care less too which makes it more frustrating. Have you had any experience with this sort of thing? Thanks

Follow these steps if you have a problem with your housing association home:

Complain to your landlord - they should have a complaints policy that you can follow.

Make a complaint to a ‘designated person’ (your MP, a local councillor or a tenant panel) if you can’t resolve the problem with your landlord.

Contact the Housing Ombudsman if you and your landlord still can’t resolve the problem.

I am going through the complaints procedure now but for the second time. If the Housing association fails to make the other tenant adhere to the tenancy will the Housing Ombudsman make them? I can’t believe I’ve been complaining for 18 months. I’ve always rented privately and never ever had an issue like this in 20 odd years. Am saving like crazy to get a private rent again and put a larger deposit down. It’s obviously cheap rent for a reason I guess!?
