Vendors asking to change completion date

crimsonlake · 13/04/2018 17:46

Half expecting this.
Made an offer on a house, raised it a little on the agreement that the vendor would move out on an agreed completion date. The vendor said she would move in until the purchase of her property completed with family so no problem.
Three weeks before we complete and prior to exchange just had a message saying they cannot complete until a couple of weeks due to their vendor.
What the heck! Really cross as they are trying to go back on their agreement as my purchase was never supposed to be dependent on their own, as in no chain as such. This is the reason I increased my offer? I have just reminded their estate agent of this.
I am in temporary accommodation as I completed on my own sale a few months ago and my belongings are in storage. It needs to be on the date we agreed as I have to vacate where I am staying and have nowhere to go unless I go in to a hotel or sofa surf. Hoping they come back and say that the will now accept the first offer I made since they cannot honour our agreement before I need to state the obvious.

Btw, we were told to aim for completion on a Thurs not a Friday - gives a day before the weekend if for any reason things go wrong. So maybe ask for completion on 10 May.

crimsonlake · 29/04/2018 12:41

Morning, yes I have issued an ultimatum via solicitor and no budging them.
Actually I have not been terribly stressed by this although I may be coming across as so, especially my last post, I blame the wine! However I should be given my circumstances. I went through 7 court hearings to get here and this is a walk in the park by comparison to that stress over the years.
Will update all you kind people over the next few days.

Good luck Crimson. I hope your vendors appreciate your patience in the face of their stubbornness!

Hope all goes well Crimson Wine

I remember many years ago, when I bought my first place, having to threaten to pull out (and mean it) from the purchase, which had supposedly been chain free. I said I didn't care where they went (they were supposedly building a new house) as that wasn't my problem. (I was in a shared rented house at the time and would have ended up sleeping on the floor in the dining room Hmm)

My parents, who were used to the Scottish system, couldn't believe how long it took for my purchase (a wee one bedroomed flat) took to complete Hmm

Wait for it..... Grin

It took 8 weeks from offer to moving in Shock which is long in Scotland Wink

I know that doesn't really help you....Wink

Have you thought about looking at property auctions as you are a cash buyer?

FiloPasty · 03/05/2018 17:43

How are you doing Crimson?

WhatsGoingOnEh · 03/05/2018 19:39

I feel for you, OP! I want you to live in the chain-free house with the protected views.

But what a lot you've had to go through! And now to be managing all this in your own. I'm really impressed with how you're handling things, and really hope you get settled in a lovely home soon.

crimsonlake · 04/05/2018 19:54

Another update for those still interested and thank you for asking again.
Well I have been to sign for the exchange, when I say sign the solicitor assures me it will not be legally binding until everyone in the chain is ready to exchange and I have paid the deposit. That was Wednesday, this morning the solicitor lets me know the sellers solicitors have not got back to him at all and what with the bank holiday he wont be in the office til Tues
I have stressed again I will not go ahead with any exchange unless the 11th of May completion date is set in stone so to speak.
Viewing another genuinely chain free house tomorrow.

Really feel for you crimson, keep looking and if these people ever get to completion o would totally say you’ll only sign for 10k less. So unfair to string it out after a promise.

planetclom · 04/05/2018 21:53

You are a flipping hero in my book, after what you have been through already.. wow, your have more mettle than me.

PrimalLass · 11/05/2018 07:45

Any update OP?

Strawberry2017 · 12/05/2018 21:17

I'd love an update- did you find somewhere new? X

crimsonlake · 13/05/2018 16:33

Update all, I have a house.
The original one which was more comfortably within my budget.
Of course not without it's dramas on the day... Completed by 11am, officially to be mine by 2pm when sellers were supposed to hand in the keys. Drove to EA and no keys, infact the EA had also not been informed by the sellers solicitor that we had completed. Obviously I was on to my solicitor about this, who to be fair was pro-active. 3.30pm still no sign of the keys, EA and solicitor were ringing seller but they would'nt pick up. 4.30pm and was told they were on their way, a 15 min journey and the keys arrived after almost another hour.
Got to the property... and the sellers were still their in the middle of moving out!! As you can imagine I was livid by their appalling behaviour. Challenged them and the daughter became aggressive! The seller was making no sense, I said it's not my problem...and the property is now mine so you are trespassing. However you cannot ' argue with stupid ' and 4 burly men! I gave them until 7pm to be out. They eventually sent a text a 8pm telling me they were out , 6 hrs late!
Luckily I did not have removal men waiting, but they did not know this.
It was a nightmare day and really took the shine off things.

BewareOfDragons · 13/05/2018 16:52

I would ask your solicitor to demand compensation from them for not being out on time. They were trespassing and you felt threatened.

Congratulations on your new home.

MessySurfaces · 13/05/2018 20:31

Yaaaaaaaay!!!!! Shitty completion day- but YOU HAVE A HOUSE!!!! Congratulations! It's been a rocky road- right to the end- and you are there now. Phew!

Helloflamingogo · 13/05/2018 21:03

Congrats that’s brilliant!

RandomMess · 13/05/2018 21:20

Thank goodness it's happened WineWineWine

crimsonlake · 13/05/2018 21:50

Thank you all and to all who posted previously, seems really weird to have got their in the end. Yes I have a house yay and no mortgage, even better.
Going to paint all rooms white initially and was planning to repaint woodwork. As it turns out the paint will need removing off the woodwork as it appears to have lots of coats on already. Any one know of a good paint stripper, or is this one for another thread?

OP posts:
FiloPasty · 14/05/2018 07:52

Crimson, so glad you are in! I hope this becomes a happy home for you x

MapleLeafRag · 14/05/2018 09:09

These types will rely on you forwarding their post (if they dare give you the new address!) Any post for them just mark RTS to “return to sender” on the outside and put back in the post box when you feel like it.
Also if there’s a landline get the number changed so you are not plagued by talk-talk type scam calls for them. Take time-stamped pictures of the meter readings, and inform utility companies. Contact council re the electoral register to get you on it, get them off it and to reduce problems if they apply for credit at your address.

MapleLeafRag · 14/05/2018 09:10

Oh and can you sand down the walls/wood instead of paint stripping?

Strawberry2017 · 14/05/2018 20:26

I'm so glad you finally got the house, they sound like horrible people and I suspect their neighbours will be glad you have moved in and got rid of them.
Enjoy your new lovely home xx

MachineBee · 14/05/2018 21:04

Another one sending you congratulations! Lovely to get a final update. Smile
