Leak down to neighbours flat

We had a burst pipe in our flat which leaked into the downstairs neighbours flat and caused water damage.

The management agent is asking me to claim through my insurance to fix the flat or pay privately. I got quoted £800 to do it so I'm a bit reluctant!!

Anyway I've called my insurance and they said it's the flat below who is responsible to get it fixed, not us.

Any advice on how to handle this?

I had the same issue, but I was the downstairs neighbour whose flat was leaked into. The upstairs flat was responsible for repairing the leak and then I had to claim on my own insurance for redecorating. I didn’t have to pay any excess, but this may have been because the damage was due to a crime (the tennent was being evicted and ripped out the water pipes) and I had crime ref numbers etc.

I would tell the management company that they have to pass it to the downstairs flat’s insurance company, who can then deal with your insurance if they chose to.

Our flat was damaged by the upstairs flats leaking shower tray. The block has insurance which the owners have to pay into and we just lodged a claim on this via the management agents. We had to submit a quote for the repairs and then once the work was done we were reimbursed but it took a couple of months to get the money back
