Moved out - help with contract , so confused!

Hi,

Any advice would be great:

I just moved out of a small house sharing with one other girl.

I moved in to the room in July on a six month contract and signed that. When that was up she asked me if I wanted to stay on for another six months through email - I said yes for a few more months but nothing was written.
I just moved out yesterday. (Very glad of this, but this is a different story!)

When I first moved in this girl told me that she rented it from her friend who owned the house (so I suspect I paid most the mortgage and she had a . I paid the rent into her account. The contract is in her name when we signed. During the tenancy we had problems - she would email me and state she was my landlord .

So I am confused where I stand. Firstly - was I a tenant or a lodger ? Secondly, I signed a contract for the first six months. I said in an email I wanted to stay on for a few more months but didn't sign anything. She says that in the contract I need to give two months notice - is this correct or as I hadn't signed anything am I on a monthly periodic tenancy now?

I would like to finish the contract as soon as possible as I can't afford to pay rent for another two months.

Thanks for all help mumsnetters!

(so I suspect I paid most the mortgage and she paid very little towards it)

I think she was your landlord. Whether she was allowed to sublet is another question....

With no signed contract your tenancy went rolling and so your notice is a month. But as she was a live in landlord you may have been a lodger so fewer rights and less notice.

Mortgage is irrelevant. Pay no more and let her sue. She won't.

Get informed of your rights next time.

Thankyou special subject. I know,I hope not to rent for a while so next time will be informed.

The actual person with the mortgage knew she was subletting and basically she was the one who I put the money into her account and she paid mortgage. She sorted out most stuff in house that went wrong like a landlord.

In my contract it stated two months notice as a tenant - do I have to adhere to this if I am a lodger?

See what the how to rent guide says. But this is all very strange. I'd just leave it - and I'm a landlord saying that.

Who was your contract with? And did you pay a deposit that needs to be returned to you?
If specialsubject says leave it, I'd leave it!

Okay , so just leave it and don't try to get deposit back but just don't pay anymore rent?
