DH hasn't been paid - Mortgage coming out tomorrow - what can you do?

For some reason Dh hasn't been paid, he has worked this month bar 3 days and he got the oddest payslip that we cannot make sense of, now there is nothing in his account. Can a company even do that? Will they just add it to next month? Even if they pay him, it may take days to clear now - and everything goes into arrears and defaults - is there anything we can do about it?

contact your bank immediately and explain the situation - see if you can get an overdraft to cover the mortgage.

Then tackle Dh's employers.

Hi QP! What does it say on the payslip? Has something been adjusted because of the tax year maybe?

have you missed payments before? our mortgage is with halifax, they try to take it out for five working days before giving up. ring them.

???????????? he has had 3 days sick, I even thought his pay would be more due to alot of holiday he never used being paid back.

not missed payments before, but it could be ages before his company pull their finger out. He got paid a few hundred short before and they never sorted it out, we gave up in the end. I know I can ring the companies, but we need to eat! I am soooo mad at his company right now.

really odd, no ni or tax deductions at all? i meant ring building society re mortgage payment, they might give you a 'holiday'.

Agree contact the bank first - otherwise you will get horrible charges. Then contact employer to resolve. Don't expect employer to cover any charges you get - they most likely won't (even though it's their fault).

no, just loads of zeros. Of course, he got this slip on Saturday when no one was in to question it. Can you make them pay you? Can they pay you when and how you like?

i shoudl think you could take them to small claims court, you have a contract after all. but it would take a wee while.

Have you checked your bank account to see whether anything has gone in? It could just be a computer error in printing the payslip (although it sounds as though it's a data entry error when putting in sick days). Also, when you contact the bank to delay the mortgage payment, it might be a good idea to move the payment day to a week after pay day in case you have a problem like this again in the future.

What a pain!

yes, big company. I have a good mind to take them to small claims court, bastards. If they don't pay us until next month I just don't know what we will do. I will camp out at their offices and eat their food, theiving gits. Checked bank, nothing has gone in. Will check again after 9, but it usually goes in just after midnight.

This is the worst possible time, so low on food, no petrol, stupid electricity meter is at about £1 He is contracted to be paid last working day of every month, not when they feel like it. IF they pay him at all. They are a bad company, they will fob him off for weeks.

If you get it sorted today, they may agree to pay for a TAPS payment (my employer wouldn't though). Any other method of payment won't get teh money to you in time for your mortgage, and you will probably be charged. So best to contact your bank and tell them what's happened.

It sounds as if there has been an error between HR and the payroll people in respect of the sick pay. Irritating, but humans do sometimes make errors which are extremely inconvenient. Rather than threatening small claims court I suggest that dh talks to both his line manager and HR and explain that a mistake has made and that he will need an emergency payment.

I would also phoen your bank and explain the error and ask them for what paperwork thsy would need fromt he company in order to ensure that you are not penalised in any way (ie explaining that the company has made an error which you expect to be rectified very shortly).

I hate to say it but these errors do happen from time to time - it is very fraught for the employee, but they can be rectified quickly if the employee informs people. If the payslip states nil then ime there is no point in hoping that something has gone into your bank account - it won't. You need to get the payslip info corrected first.

If it's a big company then it's almost certainly just an error on the part of whoever entered his pay. If they have not paid what he was owed once before then you should chase that, too.

DO contact the bank, but they won't waive charges just because you tell them he hasn't been paid - that's not their problem. You need to try to contact the building society so that they don't ask for the Direct Debit until it's sorted out.

In the meantime yourdh needs to get straight on to his payroll people to get it sorted today - reminding them that they still haven't paid what he was owed previously.

I had a similar problem once in that a company I was temping at for the summer suddenly decided not to pay me weekly as had previously been agreed at my interview but pay me a lump sum at the end of my contract (I'd negotiated the job myself). I had no option but to accept this (or leave in protest still sans pay) with a begrudging offer of 'an advance' (on a salary being paid in arrears already!) of £100 to tide me over.

I wrote to my bank to let them know what had happened and as they could see that weekly cheques had been going into my account for the past 10 weeks or so and I'd been living within the T & Cs of my account, they waived the automatic charges that were slapped on. Saved me a small fortune and my face with my creditors. Definitely tell your bank and see if you can hold off the mortgage payment or extend your overdraft to cover all your payments out until it's sorted out.

Hi QP, this has happened to me once before and i also work for a big company. My advice would be to get dh to speak to his line management and explain the situation. They can then push this through with HR (as line management will no dh's personal circumstances etc. better). Even if they gave him an advance of salary - that then gives them a couple of weeks to sort out THEIR error and they can then pay him twice at the end of this month but take back the money they gave him as an advance iyswim. They can get the money to you same day by CHAPS payment (they dont like doing this though as it costs them about £10 i think so won't offer it to you unless you push them for it). I think the cut off for a CHAPS payment is 2pm for the money to go in same day.
