Has my landlord broken the law?

Our landlord got an eviction notice and we should have been out yesterday. There were problems with our removers so we had to leave a fee things. Texted landlord to say we would be coĺlecting them today. He replied ok.

Been today and landlord has broken down back gate in order to get into garden. We think he may have bèen in house via the back door as he has a key for it (he lost his key for front door).

Now we never said we had actually moved out and although our car wasn't there I could have been there on my own.

I know once the eviction notice was up he needed to instruct bailiffs if we didn't go so has he broken the law?

While it is always difficult to know if a tenant has gone, your text would give him a reasonable assumption that the tenancy has ended which allows him access without notice. He therefore has possession and can go in. Losing keys is stupid but not relevant.

He is still responsible for your stuff, there are hoops to jump through with that although can't see a need as you said you were picking it up.

You possibly being there alone is not relevant.

You moved out yesterday, he knows this and it's his property? I don't think he's done anything wrong wanting to take possession.

But he didn't know if anyone was there or not. The car not being there means DH is probably not there. I don't drive and he knows that. I dont see why he felt the need to break down the gate. We willing be returning the house keys today along with the key for the gate. The gate is locked because we dont want our dog escaping if it blows open or someone opens it.

Why the fuck would you think it’s still your tenancy at that point? The law said you had to be gone. Yesterday.

Your text indicates you had left. In addition the poor sod had to have you evicted. You were also to be put yesterday according to the eviction notice. So no he's done nothing wrong.

I'm curious as to what part of the eviction notice saying uou had to be put yesterday is confusing you into thinking it would have been ok for you to still be there today.

We never told him we had moved out yesterday. We said we had moved some stuff but not all as we knew he would be looking to see if we were still there.

Yeah, and you're supposed to pay your bills and not force your landlord to go to court to evict you. What's your point. He can do what he wishes with his property.

Presumably he knocked and had no answer. How was he to know you had not already been and collected. What law do you think he has broken? You could ask Shelter.

Why do you care since you’ve moved out and only left a few things which presumably you’ve collected?

You wouldn’t have left a dog overnight in the house anyway because that would be a shitfest

Even the Judge said if we were not out on the date he would have to instruct bailiffs. We cant move into our new place until next week.

Good job we are not wanting the council to home us as they tell people to wait until the bailiffs come before leaving.

As for "poor sod" you know nothing about what has happened. The landlord has been a total pain in the arse and has done nothing required by law i.e. our deposit, smoke alarms, gas safety checks etc

I doubt he's broken the law. As tenants, gud you break the law? Why was it necessary to pursue an eviction?

Tell the Council you've been evicted.

Sounds like op wasn't evicted but left at the end of the section 21. And if the landlord is this bad, getting out asap is the only thing to do.

If those other things were missing thats where the law got broken. Hopefully op is moving into a legal place now.
