Seller of new home LIED about various things

Hi every one, I posted over the weekend regarding my new home purchase and now I'm experiencing vandalism & tresspassing. Someone is stubbing out fags on my new windows and it's burnt them. There are new burn marks. Also they cut the cable ties on the gate that I'd used to keep it shut as they are walking up my drive and using my garden as a short cut. I own the front garden and it's not communal, there are council tenants in the block.

Anyway, the nice neighbour above me has informed me that she was unaware the previous owner of my flat was even leaving as they never even had a for sale sign up. On top of that she apparently already had disputes with an antisocial pair of neighbours in the block who were doing the same using the garden, cutting ropes, standing outside the kitchen window smoking, and get this PARKING in the drive. Apparently that started arguments in the street and disputes. They are council tenants.

When I went to view the flat I asked mutliple times are the neighbours ok and ivwas told oh yes they're all great. NONE of this has been reported on the home report. I am in Scotland. Nothing like was reported to the solicitor either.

I have now put in a freedom of information request to the council to ask if any disputes were recorded between the seller and the tenants.

Honestly, I feel sick and gutted. Spent all my savings on finally "owning" my own place, I have multiple chronic illnesses and this is the last thing I need. I feel that the seller blatently lied to me.

@Jayfee thank you, even the asbo team for the council said I need to contact my solicitor as I should have been made aware. It's sad as I thought the seller was a lovely woman. I already explained to her about my illness and that I was moving from rented property full of heroin users and prostitutes with daily violence in the area etc. She said oh none of that here. I suppose she was right but now its a whole new can of worms.

They all know I'm a new neighbour all have approached me in the passing and said hi etc and all seemed fine.

@Sarahjconnor wow that is so concerning. Actually scary. I hope you're in a better situation. Well the ones in my block have a criminal record from harassing and being violent towards other occupants in my block. All in the court reports.

thank you every one these responses are great. I'll definitely be monitoring. Already got a cam running above the vandalised window and the other cam is being installed in the front on Thursday. All will be visible for them to see also.

It's just sickening. I have no money left after buying, all my savings are gone and now I'm having to fork out for cctv etc. I have two big surgeries coming feb/march also and the thought of dealing with stress at home is unbearable.

Flowers This is a horrible situation for you, OP. I agree with previous advice to contact your solicitor.

@sarahjconn oh wow! That is crazy. It is amazing the things that go on that you can't even imagine until it happens to you. Awful. That's good that the new woman stood her ground, I plan on doing the same to be honest. Thanks for all your info.

@screamingvalenta thanks love

Glad you are getting the cctv installed, and doing it so quickly - that should show that you are confident and not going to tolerate this. Good for you standing your ground.

Well the ones in my block have a criminal record from harassing and being violent towards other occupants in my block. All in the court reports.

How did you go about this - really important for anyone buying a flat (or a house) to do this ahead and not just for ex local authority properties. I went to view a flat in a small, gated, immaculate, private development with a young relative recently and the EA said that local council were in the process of buying two flats for their tenants when I had assumed that they were all owner occupied - but on reflection it is no different to risk ASB from a of BTL tenant, airBnB let or an owner occupier.

Hi OP hope you can get it sorted. Definitely get a big padlock for the gate and a sign saying 'no trespassing CCTV in operation'

Good luck with operations, hope you can get some respite Flowers

@another20 I agree, I wish I had done this but sadly didn't. I even know peope in purely owned outright in whole blocks etc or even in semi detached who have had neighbour issues so it can happen anywhere. I put the name of the street in Google and typed court reports after it. Also the asbo teams at local councils will give u the info if you ask.

@pannacott & @bordersmumnow123 thanks, also ordered the plaque type signs that say cctv in operation. So hopefully things get better.
