Deposit back from rental

We are renovating our house and moved our to rented accommodation for 8 months. We moved out last week and have been sent the landlady's comments by the estate agent. Just wondering what our chances are of getting our full deposit back.

  1. Landlady said that one bedroom had lots of marks and scuffs on the wall and claims it had been redecorated prior to us moving in. I have an email from me to the estate agent dated a week after we moved in listing minor amendments to the inventory which noted that that walls in that bedroom have marks and scuffs and paint drops all over. At the time, the estate agent said these comments would be added to the inventory.
  1. I got a chimney sweep out to sweep the chimney of the log-burning stove before moving out. He is a member of the Guild of Master Chimney Sweeps. He noted that a bracket at the back of the stove was broken and a back plate was loose and said this had been like this a long time. (This explains why the fire didn't give off any heat. We stopped using it in frustration about 2 months into our tenancy for this reason). He put a warning label on the wood-burner saying it was dangerous to use and noted that on his report the damage had probably been like this for some time. He also noted on his report that there was no carbon dioxide monitor in the room. There now appears to be a suggestion from the landlady that we have caused this damage. We didn't.

What do you think? If it goes to dispute, we should get our money back, right?

Definitely have a good chance of getting your full deposit back. Let it go to dispute if landlady won't agree

If you have copies both of the email about the scuff marks and the chimney report I'd send these to the agent. You should get your money back

Is the deposit lodged in one of the approved schemes?

I thought carbon monoxide detectors were compulsory now?

Co detectors are indeed compulsory in rentals with solid fuel appliances (england) and have been been since 2015. Five grand fine.

Agreed signed inventory? Did it show a detector?

How about telling her to authorise deposit return without arguing if she doesn't want this reported? And then report it anyway...

Have just checked inventory. No sign of a CO monitor. Hmm. May suggest to the estate agent they gently encourage the landlady to drop the issues given the dangerous wood-burner, lack of statutory safety equipment and potential huge fine.
