Fence next to neighbours fence

I have done loads of reading on this, but one thing I can't work out is how close to the neighbours fence can we put our own fence in our own garden?

We are trying to sell our house. Our neighbour took down the old fence while we were on holiday. As we are selling we didn't say anything (he knew this and that's why he did it). He replaced our fence with a 2 foot high fence with 5 foot posts. It looks ridiculous and the agent says it's putting people off.

The only thing we can do is to put a fence of our own up. I would like to have it as close as possible as it's next to our path up to the house so we can't lose too much space.

Does anyone know close it can be ? Thanks!

As close as you can get it as long as it is on your side.

Within the boundary on your side.

But I guess not touching? But maybe a millimetre away?

A millimetre from what? The boundary, or the fence? How close you can actually go will depend on the means of fixing the posts. You couldn't concrete on only one side of the posts and hope the neighbour's fence will support it, for example. You can get metal spikes to hold wooden posts which take up less space - your fencing contractor can advise.

From the fence itself. The fence marks the boundary.
