Fence owners

Who is responsible for a fence on joint property. We've requested the deeds but it reveals nothing.
Read on internet that it's the left or is it how the fence is facing (e.g if you have the back it's not your responsibility)?

I thought you were responsible for fences where the posts are on your side.

Here we go....

If the title register and title plan don't indicate who is responsible for what then the presumption is that the responsibility is shared.

That's generally the case but it's not law. The fence on our left at the back has the posts facing us but belongs to next door. That's because when it was last replaced (about 40 years ago) they didn't have the room to put the fence the other way round due to the shrubs in what is now our garden.

What wowfudge said.

It also depends on the need of the fence. If not named on the deeds or the neighbours not fussed about providing a fence then it comes down to want and need. I need 6ft fence panels because of a disabled child so I took responsibility for all fencing. My neighbours were happy with a wire boundary on their boundary although they took it down when new fence went up. I have the front showing to avoid climbing aris rails, front and back mean nothing.

But that's only if the fence is exactly along the boundary. There is no requirement to have a boundary structure (fence, wall, wires, hedge, etc) so if there isn't one and one of you wants to put one up but you can't agree on the division of the costs then the way to go about it is to put the fence inside the boundary on your side and pay for it all yourselves. If one side owns the fence and it's dilapidated and they won't repair it technically you should build your own and have two fences butted up to each other.

Communication is the key.

Do the neighbours deeds indicate anything ?
