Using a crane over my house

My next door neighbour has just posted me a note to say that they are having a delivery for hot tub next week .... but that it will need to be craned into their garden as they can't get it through their house.

The configuration of my driveway would mean that it'll most likely be craned over MY house. How can I tell them nicely that I don't want it going over my property?

These are the same neighbours who kicking an absolute fuss about my installing a gate over my driveway!

Don't ask anything about insurance or whatever, that suggests you will let it go over your house if they tell you the right answers. What you have sent them is perfect. It makes it clear that you will not agree to it going over your house. If they respond by trying to assure you it will be safe or whatever you need to email/solicitors letter them explicitly stating you do not grant permission for any equipment to be on or over your property.

Have you got gates you can close and lock on that day? Or park your car there so they absolutely cannot access your drive.

I've just found this out: it seems that they are craning it over my driveway and over my garage & into their garden.

My insurance company said that it's fine to do this because if anything goes wrong then they will claim it from their insurance.

I'm not happy about this at all as they didn't have the common curtesy to speak me about this Angry

Stand in your garage for the whole day. I seriously would find a way to make this impossible simply for the fact they haven't even discussed it with you.

What if they drop it on your garage?
Having said that you don't actually own the area above your house do you so maybe you can't stop them.
Bloody rude of them not to come round to ask though

Your insurance co said they will claim it from their insurance? How do they know that your neighbour (or crane company for that matter) have insurance? Anything goes wrong and your premiums will go up no doubt.

We are having a hot tub delivered in the new year. To ensure that no cranes had to be used we are taking down our fence on the day of delivery and putting a new one up on same day at our expense not our neighbours - I wouldn't want anything craned over our house

I don't fully get why they can't crane it over theirs but honestly I'm not sure that you own the air above your house so would you be entitled to refuse? Probably fine to refuse them to park on your drive but to use the space above it I'm not sure.

Hi all,
Sorry for not replying. The crane arrived this morning and set residence just outside my property boundary. I went out to speak to the operator to enquire about his potential lift path and he said assured that it wasn't going over my house. naturally I didn't take his word for it and hovered by my window to watch. I went outside to take photos once the hot tub arrived. It was quite a challenge as my toddler kept running away and expected me to chase after her.

The hot tub was lifted and my daughter was safely carried in the sling and I started taking photos in earnest. The crane operator was truthful and it didn't go anywhere near my house. It went over my neighbour's property and at one point it almost touched their roof. Apparently the neighbours wife couldn't bear to watch this operation and she arranged a coffee date with her friends.

So thanks for all of your help & advice. I'm so lucky that I wrote the letter to my neighbour and they changed the route of the hot tub :)
