Neighbours new bin port - crossing our boundary ? Can anyone help with advice please ?

Hello All, am new to the forum so apologies if I have posted in the wrong place . I have a query that hopefully someone can help me with . My neighbour has built a "bin port" right next to ( and slightly crossing our chimney breast .
The homes were built by Maunders in 1997 and the building schedule is quite "strict" for want of a better word. No sign written vans , paintwork must be kept white etc .
One, I'm not to enthralled to have their bins right by my lounge window . Every one of the other houses parks them round the back ,although I accept this is their property and can do as they wish.
If I may quote one of the clauses , I would welcome anyone's thoughts 😀

" Not to erect or maintain or suffer to be erected or maintained on such part of the property as is situate between the front and any Building Line of the property and the abutting road any building erection or structure whatsoever whether moveable or on movable or gate gatepost wall fence hedge or other partition except with the written consent with the Local Planning Authority "

The shed is also no covering our telephone wires so don't know where we would stand if we had a problem in the future ?
Appreciate any help , we get on with the neighbours so wish to be as tactful as possible or do I shut up and accept it as it is ? 😕

Yes my house is the one with the black car . Our boundary is nearer our chimney breast . They have been rather clever as the "fence part has been cut round part of the chimney breast - not drilled or bolted to our wall yet it has been bolted down to the concrete .
This is a better picture from our side I think ?!

It is rather large for bin storage , we thought they were going to build a paralllel fence to the back one and put a gate on so it would be covering the bins . The second shows how close the bins are to the air vent that goes into our lounge 😕

I don't think you can argue about the siting of their bins near your vent, after all they could be there without the enclosure. Does your satellite dish overhang the boundary? Is the boundary along the paved edging by your wall, or just short if it. They don't seem to have breeched the building line, and it is temporary anyway.

Are your their neighbour LIZS??

If your neighbour's tree overhangs in to your space you can cut it down so I'm sure the same applies here (I am NOT suggesting you cut it down).

What if the neighbours wanted a campervan with a huge awning goin into the other driveway...it's just not tennis is it?

Totally unacceptable.

Even without Documentary evidence of covenants etc there is no harm in going round, mentioning the smell & other concerns and asking them to at least move the bins & store further back. Ideally you'd want to start by appealing to their better nature anyway, rather than quoting rules at them. You could argue over the inch if you want but beware of winning the battle but losing the war.

You could try your local council under smell pollution, though I imagine they'll say lots of people have bins near their windows. But my point is, even if you can't dig out a regulation to brandish at them, you can still talk to them and others and try to persuade them.

I take it you have no access to your garden round that side?

We definately want to talk to them nicely first and ask if they could move it back . I was asking advice if we need to take it further, which hopefully we won't need to . Nobody wants to fall out with their neighbours .
@ Obeliskherder , good point I've asked for it to be removed as I don't think I can delete or edit ? Thanks 😀

Is there no covenant about where bins can be stored? I don't think asking them to move it back will work, they have abutted it against the fence between their back garden and front space. I think it's selfish on their part but I'm not sure you can do much about it. Have a builder look at whether you actually need the vent there - do you have a gas fire?

@pigletjohn , so do you think they should leave a gap between their bin fence and our chimney , almost like drawing a line down from the eaves and guttering ? That would at least help with the possible damp issue which may arise . Thanks for your help on this 😀

We had a bin store up tight to the back of the property and it caused us terrible damp issues because of the poor ventilation.

I think your angle here is the smell tbh - it's a good starting point.
