Can't sleep... Vendors changing things on day of exchange, what would you do??

Hi all.

I feel like I'm having a breakdown!! Meant to exchange yesterday with completion this Friday, and the vendors have suddenly said they want to leave their shed until their next purchase goes through, and collect at a later date! Their reason for this is apparently that they are waiting for probate on their next purchase. They agreed to move by end of June as our tenancy runs out then. We don't want to be stick with their shed until God knows when! And how would it be removed? How would we communicate this?

We said no and have heard nothing from the vendors. We need to find a new tenancy within 7 days if they don't exchange.

What do you think we should do? We feel totally drained with it all!!!

I think the problem is that you offered money and tried to make their shed issues your problem. Now they think you'll just cave.

People become stupid and unreasonable in property transactions. It's even worse if they were stupid and unreasonable people to start with.

I'm not sure what we should do now. Call back and pull out? I've been back on rightmove and there are some others that are nice... I guess there will be another

Call the agent back at 2 and say you assume that since you haven't heard anything that you need to start looking at other properties and ask to see what they have on their books.

You notify your solicitors and call your mortgage company, they'll be able to hold your mortgage and hopefully transfer it to another property. If you need mortgage help, PM me x

I also wouldn't have much else to do with this estate agent as they've already lied to you once, call them and tell them their deadline is 2pm or they all lose you as a buyer xx

Thank you everyone, all so kind for sharing this advice! I'm going to call back at half 1 as I need to be in work shortly and just say that we no longer want to go ahead. Waste of 3 months but I suppose this way we have more time to save extra pennies.. Every cloud!

The vendors will hopefully realise that they're being fools and stop with the nonsense.

If this one doesn't work out, it won't be the end of the world. There are other houses out there. You said that you can go on to a rolling rental contract too (is that right?), and you'll still be a buyer without a chain.

Don't call at 1.30 and pull out. You've set a 2pm deadline so stick to that.

Yes, told him everything and said to pull out at 2 if they haven't come back.

Are you going to 'action' pulling out at 2 or tell them you will be pulling out if not sorted by then end of the day?

What schbittery said. They are messing you around and you need to be tough and be prepared to walk away if they continue. They will either stop being ridiculous or they actually just don't want the sale to go ahead.

If you haven't from either the EA or the solicitor by 2pm you should first call your solicitor and check whether they have heard anything then call the EA and say you assume the deal is off as your solicitor hasn't heard from the vendor's solicitor. Give the EA a chance to ring the vendors again and get back to you. If it's positive then tell the EA the vendors' solicitor needs to contact yours pronto to confirm.

After the deadline pull out. Tell the agent you want to view other properties asap and will be contacting solicitors etc to halt everything tomorrow morning. The shed either goes, is included in the sale or you go.
I suspect the agent will be all over this today.

OP, are you not completely cutting off your nose to spite your face?

Give them the £150 and sell it on. Job done. That is SURELY easier and cheaper than staring again.

OP don't panic. The property market has slowed down, so if the vendors are being dicks, pull out and have a rethink.
You may find an even nicer property, which suits your situation better. This is such a large financial decision don't get bullied into doing something you're not happy with.

My bet is, when the vendor discovers you're about to walk away, they will agree to exchange and complete. Make sure your solicitor includes financial penalties if the shed remains in the garden post completion.

I also agree with doing what wowfudge suggests

they wont just take the £150 - they are insisting on being able to come back weeks later and get the shed.
