Enforcing a court order to sell - how long?

Sellers are divorcing. He is refusing to sign the paperwork. Discovered that there is a court order in place so she is instructing her solicitors to enforce it tomorrow.

So how long will that take?

So she has a buyer and is trying to enforcing the court order so the sale can go ahead? Or still trying to get it on the market?

In either case they will probably write a few threatening letters to ex then they will have to go to court to enforce the sale, so at least 8 weeks. Solicitor will be able to give her better idea.

I'm the buyer, my offer was accepted mid February. We were due to exchange last week but her ex husabnd claimed he hadn't recieved any paperwork (rubbish) it was re-sent recorded last week. Now he's not answering his phone.

Neither of them live in the property, its empty. Their kids are adults.

He's just being awkward. I found out yesterday that there is a court order to sell the house. She was giving him until today to sign and move forward with the sale.

She's going to instruct her solicitors to enforce the court order. I'm hoping this makes him have a change of heart and he signs.

My buyers are waiting to move in. It's a nightmare.

I believe that an Order can be made whereby the Judge will sign the papers instead of the DH.

Even getting papers in front of a judge will take a few weeks, most courts share judges and they only visit once a week to do routine paperwork.
