I'm still (frustratingly) trying to sell my house. Viewings seem to have dried up from the current agent, and still no sign of an offer (despite loads of viewings).
They recognise that they're not doing well, so they've agreed to let me out of the sole agency agreement & go to a multi agency deal (& keep the same fees). The new agent (who has the house I want to buy) has agreed to match fees too, so all well and good.

But - the existing agency won't provide a list of the people who they've done viewings with. They're saying that if an offer's received, then they'll check the details against their list. But that can't be right, surely? Surely they need to provide a list, and then if the new agent gets an enquiry he can check against the list & tell them to go through the old agent if necessary? Otherwise he could effectively do the work to seal an offer, and then they'd get the commission.
What's normal in these cases? Do they have to provide a list, or can they withhold the info? I'm just concerned that I don't want to end up with both agents expecting to get paid.
