Where do I stand?

We are preparing to move into a rented property at the end of the month and have already paid the month upfront and deposit. When I viewed initially there were some fence panels down on both sides. The landlord has arranged for his side to be replaced etc and we were prepared to replace the three or four that were on the other side belonging to the neighbour. I went back today and since then the neighbour's side has become far worse and it now appears the whole thing needs to be replaced. Panels are down and broken up, laying half in their garden, half in ours.

One of the main reasons we chose the prospect was because of the large garden for our children.

The neighbour has sold and will be moving out but we of course have no idea about time scales for the new owners or whine they plan to fix the fence, if at all!!

What can I do? I know it's not the landl

I know it's not the landlords responsibility but can they reasonably us to get on with it as it is?

I don't see how you can expect your landlord to do anything - it's not his fence. It is your neighbour's responsibility but there is no legal requirement to have a fence marking a boundary at all so if your neighbour is happy to let the fence fall into disrepair and not do anything about it, then there is little you can do except replace it yourself, leave it as it is or build a new fence inside the boundary on your side. If your neighbour (or new neighbour) has a dog however, it is his responsibility to keep his dog in his garden so that might be an incentive to replace the fence sooner rather than later. Perhaps you need to speak to the neighbour to ascertain what their intentions are and whether you can reach an agreement/compromise.

I am not really sure what you are asking?
Do you want to cancel your arrangement and not take the property? If so just phone the letting agent and tell them that due to the fence being completely down it is not in the same condition as when you viewed it, even though it is neighbour's fence.
If you do take the property
You can throw the fence back in to the neighbours garden. You might be able to put up a cheap temporary barrier instead of replacing the fence?

We can't cancel the arrangement now and to be honest apart from the fence the property is ideal for us.
I'm just disappointed that we are in a position where we have to just put up and shut up so to speak. Was hoping that there was something relating to the provision of security by the landlord which meant they would assist us in fixing the fence.
Completely gutted that this has happened if I'm honest.

actually it IS the landlord's problem - he needs to get the bits of fence belonging to the neighbour back to the neighbours garden, not cluttering yours.

you don't do building work as a tenant!

speak to the landlord; while he may not want to put up a big fence, a length of chicken wire and some poles will provide a temporary boundary. When the new neighbours move in HE can deal with them.

Agree put up a chicken wire fence on your side of the boundary , or ask ll to. When we bought our property there was a storm before exchange and we asked for the fences to be reinstated before proceeding . Might be worth ll contacting the owner or estate agent.

I've insisted the landlord visit the property with the agent and myself so he can see the extent of the problem.
I'll make sure they know the fencing laying on our side needs to be removed and will suggest the wire fencing as a temporary measure. Thanks for your help.
I think the early pg hormones are fighting to take over so level headed advice was definitely needed!

I'm sure the landlord will be fine, but to confirm - if it belongs to him, he fixes it for all wear and tear situations. Which this is.

especially as you don't even live there yet!
