Unusual situation - will I have to pay stamp duty?

I inherited a third of a house and am buying the other two thirds off relatives.

The whole house price is 135k but a third of that is mine already. As I'm only paying two thirds of the 135k will I have to pay stamp duty?

Also am I likely to need a solicitor to oversee the purchase? One of the relatives is executor of the will and it sounds like the House is still currently in the name of the person who died. Can we just put it in my name once I've written them a cheque? There's no mortgage on the house at the minute and we're hoping to extend the mortgage on our home to fund this other house.

Personally I would get a solicitor - you want to ensure it is under your name legally and the other relatives have legal papers to show the transaction is completed. If nothing else at a time of grief people can get a little emotional and sometimes I think solicitors act as a buffer.
You will also then get advice re IHT - I haven't done legal for 3 years so don't want to advice as out of touch, but generally if you aren't over the threshold you should be alright. Please do get legal advice though - £300 should about cover it, and worth it to ensure it is all airtight I think.

I am not sure about the stamp duty position but I think you will need a solicitor to deal with the transfer of the title into your name and for the registration of the title deed. It's a good idea to get legal advice on it anyway.

Thanks. Have done loads of googling and it looks like I don't have to pay stamp duty. Will get a solicitor though.
