Whose name to put rental property in?

My husband and I own a property. It's our old house. We're both on the mortgage. We're going to rent it out. Can we put all the lettings stuff just in his name? And he just do a tax return for it? Or does it have to be in my name too as I part own it and am on the mortgage?

not sure about 'have to' but makes sense to both be on the details as then you can split the income for tax purposes.

just to check (forgive if obvious)

  • you have mortgage co. permission
  • you will have appropriate insurance: buildings, contents, legal, malicious damage
  • you know about gas safe, deposit protection etc etc etc ad infinitum

Yep know all those bits but thanks for checking. I've read many many threads so going in with eyes open.

We won't get any tax benefit from sharing it, I don't think. Both not near the 40% threshold. All personal allowances used up. But if we both have to declare it on our student loan forms that will be expensive as they do it on gross not net, very frustratingly.

If both names are on the title deeds then both are liable to declare to the revenue.

I think you can do a declaration of beneficial interest even if joint owners, in which you state that one person has 100% entitlement to the income, and only that person pays tax. Check HMRC website www.hmrc.gov.uk
