First post here so I hope this is the right section. Came across this site trying to shed light on the following problem, seems like a good place to start.
I recently moved into a new home. Over the past few weeks a cable that runs over our roof started blowing around in all the wind. It causes quite a lot of noise when the winds up, which is annoying. We also developed some problems with the roof where the cable is lying around the same time (loose tiles and leaks) although it is unclear whether they are due to the cable, the adverse weather or poorly completed repairs by the previous owner. I'm sure the cable could cause some damage in the long term as it blows around a lot.
On inspecting the cable a bit closer I noticed that it comes out of my neighbours sky dish and runs to the back of their house, via our roof. Due to the way the roofs are pitched it would be difficult to have run it over their roof. When I raised the subject with them they told me that the sky engineer had installed it that way as sky would not accept liability for fixing it down and it would appear that running it over their own roof would have involved fixing it down.
I don't really want any dispute with the neighbours over this (especially as we only moved in three months ago) but I don't want the cable there either. Sky refused to discuss it with me unless I put a complaint in writing but I'd like to know what my rights are regarding this cable. I left things amicably with the neighbours and mentioned that I might clip it out of the way during some forthcoming work on our roof, however I since thought that it might be best not to touch it myself as it probably belongs to sky, who I'm sure could be quick to charge me for any damage caused. I also don't see why I should risk myself going up on the roof to fix something which is ultimately for the benefit of my neighbours viewing pleasure.
I'm aware of the principal of the 'access to neighbouring land act' which I don't think would allow sky to have installed the cable over my roof in the first place.
The whole situation is complicated further by the fact the roof was repaired just before we moved in by the previous owners under the original NHBC 10 years guarantee.
Any input on this matter would be appreciated.
