Can I make them get rid of this bed? (house purchase)

We're buying a flat which has been previously let furnished. I specified when I put in my offer that we had our own furniture and didn't want anything left.

Anyway, we've nearly finished the process and are working towards completing and moving on Monday. My solicitor has emailed to say that they're leaving a king sized bed.

I don't want the bloody bed! We won't be able to get our own bed in before it's out, and its a 2nd floor flat so it'll be a pain to remove.

Can I make it a condition of the sale that they get rid of the bed before Monday?

If they didn't list it on the particulars to be left questionnaire they have to remove it.

Tell your solicitor they don't get to tell you they are dumping stuff in your new property and tell them to shift it.

Yes, they have to move it. You can ask your solicitor to hold a portion of the money back and if they have left it, use the money to get it removed.

I'll tell them to shift it then. They've already been told weeks ago that I didn't want it so they clearly just can't be bothered moving it!

Nancy, I'd be happy to free cycle it if it wasn't that there is literally nowhere for my furniture to go with the bed there so we'd be getting the keys and then have the movers twiddling their thumbs while I tried to dismantle this bed...

Yes, absolutely you can. I did the same when the previous owners wanted to leave their stinking cat pee carpets that were a million years old. Absolutely insist that the bed goes. Lazy bastards can't be bothered to dump it. Its their problem, don't make it yours.

On the plus side, I didn't realise when we viewed that the bed in there was king sized so the room is bigger than it looked (we have a double). So that's something.

Agree with getting them to clear the flat. The elderly owners we were buying off asked if we'd mind if they left a few old tools in the shed and garage. We felt sorry for them so said we didn't mind. When we moved in we found the shed and garage were filled top to bottom with junk. It took us months to get it all to the tip. Be firm.

If you have movers they will take it downstairs for you.
Put it on freecycle, Facebook selling etc, to be collected afternoon of xx will be outside. Someone will take it. You are already paying movers

But why? Really? Why should she do this? The people moving out are also paying movers. Confused. There is no way I would do this. If you're selling your house you take your furniture. Not leave it for someone else to deal with.

I wouldn't. Its amazing how quickly people will move stuff when they are also selling before christmas. Or at any time really.

Utterly refuse. They have had months to sort this. Most councils will do a bulky collection, it about 35 quid here. But they stop the week before Christmas

Talk to your solicitor and have it specified on the contract, we did this for some outbuildings. Also have it written in that you want access at exchange to check flat is empty.

It's clearly an awkward pain in the arse object or they'd have got rid of it when they cleared everything else. They'll have already moved two other beds and 3 piece suite and a wardrobe.

Get it written down in the contract, they need to know you're serious or might just pay lip service and ignore you

Our sellers tried to convince us that we had to purchase their hot tub as they didn't want to pay to have it removed from the bottom of the garden. According to them they couldn't guarantee they would be able to remove it without causing significant damage to the property and it would be in our interests to buy it for £500.

Amazingly we didn't take them up on their offer and they managed to get it moved just fine. They did forget to take their boat though Hmm

Make sure they take it... Our vendors kindly left us their kitchen table, we found out why when we came to remove it as part of the kitchen renovations. We had to saw it in half to remove it as it wouldn't go through the doors.

our seller left us her fridge, which wasn't in the fixtures and fittings and she hadn't said anything. complete PITA because we had bought a brand new fridge but if we'd known she was leaving hers we would have hung on and used that for a bit as it was in good condition. she probably thought she was doing us a favour but actually she just gave us another bloody job to do. fortunately a friend of ours was in desperate need so was able to take it off our hands

i believe that if they do leave things not in fixtures and fittings you might be able to chase them for costs of removal?
