Do you have restrictions tied into your freehold property contract? Like right of first refusal?

We bought our house 3 years ago and are now in the processing of trying to switch mortage providers, however because the house we bought was a repossession from a local housing provider, they made certain stipulations on the contract, one of which was right of first refusal. This has resulted in us being rejected for a better mortgage deal despite the fact that it's only a 40% mortgage.

I can't find anymore info about right of first refusal on freehold properties so wondered if anyone had suffered the same problems? Does it always remain on the property, even if you pay off the entire mortgage one day? Is there any way you can appeal this?

Try posting this on legal matters. Did your solicitor warn you about this at the time of purchase? It is a very odd clause.

It is an odd clause. Our solicitor was shit. We had to keep sending the contract back to him because we spotted things that they had not and every time we sent it back we had to wait another couple of weeks for the solicitors their end to redraft it.

Finally we had to accept this contract which the solicitor assured us was very normal when buying a house from a housing association as they have a vested interest since they own what is now the minority of the houses on our small estate.

Yet it is a restrictive contract and we had no idea that it would affect us moving our mortgage. We are now worried about how it might affect any future sales and whether it will still be there even if we pay off the mortgage outright.

We need legal advice but not sure where to go as original solicitor was so shit and would probably charge us for advice.

MHNQ can you move this to legal stuff please? Sorry, I cocked up by putting it in property.
