Estate agents and their bloody dripfeeding.......

We've had an offer accepted on a flat. Estate agent told us that as soon as we had booked the valuation survey, tenants would be given 2 months notice. OK. Valuation survey booked on 6 Sept - oh no, notice will be given when survey has been completed Hmm Couldn't see what would be gained by arguing about it, so left it. Probably a mistake.

Survey done on 20th, came back fine. Now being told that notice will be given to tenants on 30th September, as it has to be done on a day that rent is due. So potentially they could still be there on 29th November, which is over 3 weeks later than they should have been out. And seller's solicitor has sent sweet fanny adams to our solicitor. Estate agents not ringing me back Angry. Phoned them this morning and got a bit shirty on the phone - EA phoned me back just now and was all chirpy and 'how's your day going?' Hmm

Dear god, we just want to MOVE!!!! We've been at this nearly 4 months (2 other places fell through before this one). It feels like every scrap of information has to be extracted with tweezers and even then the goalposts keep moving. We have to be out of our place by end of October so getting very worried now.

Just needed a good vent and a metaphorical scream into a pilllow Smile Thanks for reading

And that's assuming the tenants actually leave. What will you do if they stay put and you have to go to court?

Is there any accountability on the part of the estate agent?

Get a date for exchange/move set and get ur solicitor to put in a clause about vacant possession and a charge to the seller if its delayed.

Perhaps post on legal for advice on what I'm trying to say.

Its likely the tenant won't shift and it may have to go to court. (Especially If they want the council to consider them homeless.) So its important if its delayed ur not paying and u don't have mortgage problems because of it not being transferred or ur mortgage offer running out.

Haven't got any advice to offer but you have my sympathies. We are the other way round, selling our house and have a rental house to move into 2 weeks today but are still waiting for confirmation of when exchange can happen - HOPEFULLY this week.

We accepted the offer in March but the house sale has dragged on and on. Every time we think things are sorted something else comes up. I feel like I've had a temporary personality transplant due to the waves of anxiety, highs and lows etc. Conveyancer seems uninterested, EA is generally good but you really do have to ring every day if you want information - they don't ring you!

I really hope you get sorted soon.

Well the good news is that the tenants have bought a property of their own and are hoping to exchange sooner rather than later so they should be out before end of Nov. It's highly unlikely they will refuse to leave. However, I just can't believe anything until it actually happens.

Just sick of all the slippery nonsense and having to beg for every scrap of info Angry

I would say if notice not given at the end of this month the sale is off. Don't do your searches or anything until you know notice has been given.

It's just awful, isn't it? Both DP and I have been suffering from depression anyway this year - this has not really been what we needed! We have been renting a really lovely flat for the last 6 years and landlady has decided to sell, which of course she is entitled to do, but it has really unsettled us both. Feels like we don't live anywhere at the moment. And while we are happy with the flat in many ways, we both feel a bit worried that we're settling for somewhere that's ok rather than great, because of time pressure.

Oh good. one less thing to worry about. But the estate agents have no liability here at all? How would you find out what if any legal obligations they have? Or if there's any procedure to follow, or if you have anything else you can do from your end?

I have no idea what their legal obligations are Hecsy. It's unlikely it will come to that, I'm just sick of having to kick their arses every single day and wait for a phone call for them to tell me yet another thing has changed.

Just want to move and be done with it and then get on with the rest of our lives Smile

If you give a tenant. Price to quit it does have to be the day before the months rent in advance is payable. You can't just do it on any day that suits you.

Tbh, even if notice had been given on 6 September, the tenants still wouldn't have had to leave until the end of November (if they obeyed the notice) as it is two months from the next rent day so you'd be in the same position. Estate agents just passing on messages from fairly hopeless clients, in this case.

or don't exchange until the tenants give notice - if they do it is only a month, as opposed to two months from the landlord.

unfortunately you are stuck with the vendors choice of agent and do indeed have to keep kicking them. Make a real nuisance of yourself so they will do the work if only to get rid of you.
