If you could potentially gain a few feet extra of garden would you do it?

On the plans for our garden it shows that the garden boundary should be longer than it currently is although it is only by 6foot max and just in the corner.

The house our garden meets is still a council house so I am tempted to ask for our extra piece of garden but dp is reluctant.

Would or has anyone ever done this please and if I do decide to how do I go about it please?

if council just notify council and they might do it! Sue them or better get them to pay annual rent until they move fence! ...or something. .

That sounds like a good idea - I wonder if I can back date the rent Wink .

I think I might look into the whole thing further as we have paid for that piece of garden!

My neighbours have 18 inches along the full length of my garden but it would just be more for me to weed, plus there is a massive tree officially on my land but because if the stollen 18 inches they thing it's theirs so pay for pruning etc

ahh now if I was in your position chicken I wouldn't worry but I am tempted to raise the issue.

Absolutely not. Sounds like a legal nightmare, it's going to piss your neighbour right off and you'll have a load of work to do to incorporate the extra bit into your garden in a natural way. Life is too short for boundary disputes.

not that difficult! removal of fence on your land..replace at boundary!

It does look as though we would just be able to move our fence which we want to replace at some point anyway.

As the garden goes at the moment the bottom fence is diagonal to the rest of the garden for about 3 fence panels and then the 4th turns back to being straight along whereas the plans say it should carry on diagonally until a point is formed with the side fence. If that actually makes sense Smile

Hold on. Isn't there some law about if some of your land has been used by someone else for a certain period of time then they gain the right to continue doing so, something like that?

I think it may depend on how long your fence has been in this position.

not any more. to register land as adverse posession you now have to notify the landowner and seek their agreement. If they haven't applied it is still your land.

oohh notdead I was on the verge of giving up before I had even started because I thought that the other posters could be correct and it wouldn't be worth my while.

I shall now make friends with google and see what I can find out Smile
