Building control and fire regs

Not the most thrilling of topics, but ...

We've just finished (well, almost) a two storey extension to our house. The plans were drawn by an architect and we got planning and building regs approval. Building regs have visited throughout the build. Yesterday the building regs inspector came round for what we hoped was final sign off. All was fine but he has failed us because the window in our new bedroom is not a fire escape window. The windows are these, chosen because they match the existing windows. Planning specified that we needed to get the same frames as the existing windows.

I am gutted that no-one has pointed this out until now - surely between the building regs dept, the architect and the builders someone should have known about the regulations??

Has anyone been in the same position and what happened? Magnet do not produce a fire escape version of the matching windows. None of the other windows in the house are fire escape types. Could we fight this or will we have to bin a perfectly good, six month old window frame and replace it with something non matching?

It's maybe done slightly differently in Scotland - but when we submitted our plans (ie before the work could be started), the Building Officer had to have a number of details confirmed (eg that there would be sufficient ventilation and that the door to the kitchen would have the correct fire rating).

Did you have to do this and if so, did they mention that you need to have a "fire escape" window?
